Type E Botulism has killed thousands of loons, mergansers, and other birds on Lakes Ontario and Erie since 1998. So when biologist Tom Langen heard two dead seagulls on the St. Lawrence River had it, he investigated. He took a 350-mile boat ride along the length of the river. He collected all the dead birds and fish he could find for testing.


Langen says the toxin is related to invasive species like the round goby and zebra mussels and passed up the food chain.


“The link seems to be somehow associated between mussels, the fish which feed on the mussels, and then the birds and fish that feed on the round gobies or feed on the mussels.”


Langen says stopping the spread of Type E Botulism is also important for people. Humans can get the disease if they eat birds or fish that are contaminated.

But there are a lot of lakefront property owners who believe that beach strolling amounts to trespassing. And in at least two states in the region, that dispute has wound up in the courts. Many people enjoy strolling the beaches of the Great Lakes, and believe it’s as much their shoreline as anyone else’s. But there are a lot of lakefront property owners who believe that beach strolling amounts to trespassing, and in at least two states in the region, that dispute has wound up in the courts. The Great Lakes Radio Consortium’s Rick Pluta has more:


In Michigan, the state Supreme Court recently declared the entire 3,200 miles of Great Lakes coast is public property. But a group of lakefront property owners says the decision has created a host of problems.


They’re complaining that it appears to leave them with no recourse for dealing with people who cross the line of considerate behavior, such as loud picnickers, and careless dog-walkers. Ernie Krygier is with one of the most active property owners’ groups, Save Our Shoreline.


“There’s a lot of other instances that we’re concerned with, and it all goes back to ownership and control to the water’s edge. If you don’t own it, it’s going to be very difficult to control it.”


The Michigan property owners now want the state Supreme Court to issue a more-detailed ruling on what’s allowed and not allowed on the Great Lakes beaches. Krygier says they’re also hoping to win back at least some of the shoreline.


If not, he says, the property owners could file a lawsuit claiming the court’s action amounts to a seizure of their property, and they’re entitled to perhaps billions of dollars in compensation.

A sign posted here on a Lake Michigan beach by a property owners’ association warns people who might wander past that they’re about to tread upon private property, but many people walk right past it anyway to enjoy a stroll on the shoreline. Jim Wright lives nearby, and says he’s walked this stretch of beach for twenty years.


“They, they put out little signs and that. But the signs, you know, are not anything official. It’s just something they got from a signmaker. And so we just kind of ignore them, and they accept them being ignored.”


The recent Michigan Supreme Court said it’s okay for Wright and everyone else to ignore the sign. The ruling said Great Lakes beaches are a unique resource, held in trust by the state for the public to use and enjoy.


The court said public access in Michigan extends from the water to the high water line. That line meanders from beach to beach, from lake to lake, and from season to season. It’s generally indicated by debris deposits, or the absence of beach grass and other vegetation, and Jim Wright says the court made the right decision.


“I’ve always felt that the whole shoreline belongs to the state and no one person, so that was a good ruling that they made and I think most people will be very happy with it.”


It’s a controversy that’s playing out in other Great Lakes states. In Ohio, officials are saying the Michigan decision supports their position that the Lake Erie coast belongs to the public. Shoreline property owners there are suing the state, asking a federal court to declare they own the beaches adjacent to their property.


Noah Hall is a Wayne State University environmental law professor who’s filed briefs on behalf of conservation organizations supporting public access to the entire Great Lakes shoreline. He says the Michigan decision will have a regional impact.


“I think that it would be completely reasonable and expected for another state to look very hard at Michigan’s reasoning and analysis in this case and probably adopt a similar line.”


He says the Michigan decision is a boost to those arguing the entire Great Lakes shoreline belongs to the public, and not to any private interest.

Undercover Agents Catch Wildlife Violators

A Columbus man has been sentenced to a year in federal prison for illegally buying and selling fifty-three Blandings turtles, protected by federal law. Over the past three years, fifty-seven other dealers in the region have been convicted for illegal trading in turtles, snakes, and lizards.


Jim McCormack of the Ohio Natural Resources Department says Ohio’s population of Blandings turtles has been decimated by wetlands destruction along Lake Erie. He says the thousand or so that survive must be protected so they don’t go extinct and prompt a domino effect on other animals and plants.


“We don’t want to see anything, whether it’s as obscure as some rare lichen or moss to something as showy and obvious and noteworthy as that turtle, to disappear.”


Wisconsin, Minnesota, and Illinois classify the Blandings turtle as “threatened,” and Indiana classifies it as “endangered.”

Nebbe: “Charles, in your book, all of the water disappears from the Lakes and you take us on a tour of all the lakebeds, so we see landforms and shipwrecks and a whole lot of mud… What gave you the idea to show kids what the Lakes would look like without water?”


Barker: “Well, actually, it was from looking at some maps that are put out by the National Geophysical Data Center that show, basically, what’s on the lake floors, and I, for one, had not given it much thought ’till seeing these maps. But these maps have some really cool features like ridges of rock and all kinds of neat stuff and I thought this would be a great idea for a children’s book.”


Nebbe: “What do you think some of the coolest features that you’ve been able to put into the book are?”


Barker: “Um, well, there’s a suspected meteor impact crater on the east side of Lake Ontario, and it’s not confirmed as a meteor impact crater, but a lot of other things it could be have been ruled out. So that’s pretty neat. There’s also, to me, what’s most exciting is the ridge of rock, or ridges of rock underneath Lake Huron, that, in some cases, have maybe four hundred feet of relief. And most of the maps we see of the Great Lakes are basically just a flat blue, so seeing what’s under the Lakes I thought was really exciting.”


Nebbe: “When I was reading the book, I thought, you know, if I were a kid, this would be pretty scary to me because all the water goes away from the lakes and, you know, there are fish dying in at least one picture. Why did you decide to show us the bottom of the Lakes in that way?”


Barker: “Well, actually, that’s pretty much how… the only way I could figure out how to show them, I mean, if we’re talking about features that are on the lake floors, then somehow we’ve got to get rid of the water to see those, and sort of… it’s a fanciful sort of draining away of the Lakes, if you will. The purpose of the book is almost twofold: one is to show that the lake floors are pretty cool, and there’s some neat features under there, but also to sort of reinforce that hey, we’d better make sure this never happens, you know, so it goes to the protection of the Lakes as well.”


Nebbe: “The culprit in your book is water usage among communities in the Great Lakes Basin and there are rules that govern water usage among those communities, one of them is that they have to return the amount of water that they use and that communities outside the basin can’t use the water without approval. Why did you pick that as the culprit?”


Barker: “Well, that’s a good question and it sort of goes back to the original manuscript draft, and I thought, well, gosh, the villain could be actually just everybody taking a little bit of water thinking that it doesn’t matter, but the cummulative effect of that mindset causes a problem, and I think that’s true, I work in environmental consulting, and I can attest that that’s basically how major contamination sites are created is that everybody thinking, ‘Oh well this one little thing won’t matter, this little drop of tetrachlorethyline won’t matter,’ but if everybody has that mindset, then, yeah there’s going to be a problem.”


Nebbe: “You’ve been talking to some of the kids who are reading the book, do you think that message is getting across?”


Barker: “Yeah, I think, you know, initially, they really kind of like to sort of see the pictures and hear and learn about the lake floors and whatnot, but I think it’s important to, you know, relay to kids that they’re actually going to be the ones making decisions down the road about Great Lakes withdrawals and whatnot, and recently, I was just talking to somebody and remembering back to when I was a kid, we used to sail a lot on the Great Lakes, and I remember being in the middle of Lake Erie, sort of out of the sight of land, and sailing through soap suds. It was terrible. I mean, Lake Erie was horrible. This was in the early seventies. And it was like you’re in a bath tub with soap suds. That’s more of a water quality issue, but I think it sort of became a problem because of nobody really, um, paying much attention. So, I think the more attention we pay to the Great Lakes, in terms of just making sure no wacky ideas about withdrawal go through, then that’s good. That’s what we need to do.”

Votes from many of Ohio’s farmers helped President Bush win re-election last year. Now many of them feel betrayed because the President’s 2006 budget proposal calls for federal agriculture spending to be cut by nearly ten-percent. The cuts would drastically reduce farm subsidies… and they would curtail agricultural research efforts. The Great Lakes Radio Consortium’s Kevin Niedermier reports that would be an especially big problem for a fairly new crop in the Midwest… grapes for wine:

Now many of them feel betrayed because the President’s 2006 budget proposal calls for
federal agriculture spending to be cut by nearly ten-percent. The cuts would drastically
reduce farm subsidies… and they would curtail agricultural research efforts. The Great
Lakes Radio Consortium’s Kevin Niedermier reports that would be an especially big
problem for a fairly new crop in the Midwest…grapes for wine:


President Bush wants to cut agriculture spending by more than eight billion dollars as he
looks for ways to reduce the federal deficit. If Congress approves the proposed cuts,
agricultural research at all of the nation’s land grant universities would suffer. For
example, Ohio State University’s Agriculture Research Center in Wooster, Ohio, would
lose six-million dollars. Director Steven Slack says, when you multiply that reduction by
all the research universities across the region… it could mean a lot of cuts.


“If that budget goes through this October, we would see an impact that would reduce
about 200 faculty positions, about 400 staff positions, and about 550 graduate students
that are supported in the north central region, and these are the states from Ohio to the
east and Iowa to the west.”


One of the newer ag industries that has benefited greatly from federally supported
agricultural research is America’s wine producers. For instance, university research into
“bio-dynamic” farming can help vineyards produce wines that don’t rely on synthetic
fertilizers, pesticides or fungicides. Instead, it uses natural methods. It’s like organic
farming…. only it limits the materials used to grow a crop to the farm on which the crop
grows. It’s a closed system.


Under the President’s budget, that kind of research and much more would be cut
at a time when the Midwest wine industry is just getting a good start.


During the last few decades, U.S. wineries have grown from a few hundred, to more than
35, 000 according to the Ohio Wine Producers Association. Most of them are small,
family run operations.


Near the Lake Erie shore just outside Cleveland, Lee Kling-Shern runs the
ten-thousand gallon a year Klingshirn Winery. As wineries in this part of the world go…
his is an old one. His grandfather began growing grapes and making wine on this farm in
1937. Klingshirn says federally funded research made it possible for Midwest vineyards
to grow better varieties of wine grapes…like Viniferas.


“And it’s only been in the last 30 years that technology and research has brought
recommendations to ambitious growers like ourselves to explain how best to handle these
tender varieties and make them work in the field. And thus, today our business is now at
a competitive level with other wine-producing areas of the world as far as the varieties
that we can produce and the quality that we can make. And allows us to be something
worthwhile to come see and do and experience.”


Like Ohio wineries, vintners in states such as New York, Michigan, Illinois, and Missouri
have turned out higher and higher quality wines. Klingshirn is worried that federal cuts
to research spending will make it harder for small vineyards to stay competitive….


“There was finally a research development operation slated to be built at Cornell-New
York which would apply to our style of viticulture here, that as far as I understand has hit
the trash can at this point. So, that’s something we’ve needed for years and years and
years and just as we’re on the cusp of getting it, it’s pulled away.”


Klingshirn and other vintners are also upset that the Bush budget proposes a fifty dollar
fee be paid by winemakers anytime they change the label on a bottle. The money would
be used to pay inspectors who make sure the new labels meet federal standards for health
warnings and other required information.


The vineyard owners and winemakers say the new fees and research cuts are bad timing
for the wine industry in the Midwest, just as many of the vintners were beginning to win
gold medals nationally and internationally.


They’re afraid their progress will be tarnished by the Bush Administration’s proposed
budget.

Fishing for walleye is a big sport on Lake Erie, but many people do
not know that the fish also live in the Ohio River.
Matthew White is a Biological Sciences professor at Ohio University.
He helped determine that the Ohio River walleye have a different
genetic
make-up from those in Lake Erie and other northern lakes.


White says the original walleye species was severed from the other
tens of thousands of years ago when the river that is now the Ohio was
blocked and stopped flowing into Lake Erie.


“These walleye evolved in the river, so they’re well adapted to the
river environment. And these walleye have also survived the 100 years of
abuse that we heaped on the river.”


Armed with this new information, wildlife officials are taking steps
to alter their practice of importing Lake Erie Walleye.
Instead, they’ll use the native species for their stocking program.

Orvosh: “Step right in there.”


Murray: “Ok, thanks.”


For Don Orvosh, an elevator ride nearly 2000 feet underground is just part of the daily grind.

“It’s about a four and a half minute ride to the bottom. 1800… about 1800 feet.”


Orvosh supervises the Cleveland salt mine owned by Cargill Corporation. It’s one of only eleven active salt mines in the country. The mine lies beneath the northern edge of Cleveland and extends about four miles under Lake Erie.


Orvosh: “Most people in the city don’t even realize there’s a mine right here.”


Murray: “Are you all the way down?”


Orvosh: “We’re at the bottom right now. This is it.”

A few feet from the elevator, Orvosh walks through a series of air-locked metal doors. They rotate to reveal a subterranean repair shop. Massive dump trucks and cranes are fixed here. The cavernous room is also the starting point for hundreds of miles of tunnels. These tunnels connect a honeycomb of old and active areas in the mine. Everyday, 150 workers travel this salt encrusted labyrinth by truck or tram.


“We’re going to get in this little buggy here now and in a couple minutes we’ll be under the lake.”


Lake Erie is a geological newcomer compared to the salt buried below it. This bed – extending from upper New York to Michigan – was formed 410 million years ago. That’s when an ancient sea retreated and left behind its brine. Oil drillers accidentally discovered the deposit in the 1860’s. As Orvosh drives north through the dark passageways, he says salt wasn’t extracted here until many years later.


“This shaft was sunk in the late fifties and the actual mining of salt occurred, started in the early sixties so it’s been here 40 plus years.”


In the last four decades, the mining process has stayed pretty much the same. Orvosh compares it to the room and pillar method used in underground coal extraction. He points up ahead to a brightly lit chamber. Machine generated light bounces off the room’s briny, white walls. Its 20 foot high ceiling is bolstered by pillars of salt the size of double-wide trailers.


Orvosh: “This is an active production section. This is where we are mining salt.”


Murray: “What’s happening here?”


Orvosh: “He’s drilling the face here.”


A miner sits atop a machine with a large needle nosed drill. It bores six holes into the seam. Later in the day, workers will load explosives in the holes and blow out big chunks of salt. Farther into the mine, the loose salt from last night’s blasting is being scooped up by front-end loaders and dumped into a crusher. All of the big chunks are broken into small pieces. Then the salt is loaded on conveyor belts and sent to the mine’s three-story-high underground mill. Salt is crushed, sized, screened and sent to the surface by elevator.


All told, the crews at the Cleveland mine produce two million tons of salt a year. A sizable chunk of the 15 million tons of salt used on icy US roads each winter. Demand for road salt has skyrocketed since it was introduced as a de-icer in the early 1950s. But Robert Springer, a 27- year veteran at this operation, says each mine fights for a market share.


Springer: “It is a competitive market. There’s another salt mine just in the Cleveland area, out there in Morton, Morton Salt.”


Murray: “We needed you today. The roads were really icy. Do you look forward to icy days to keep production up?”


Springer: “I guess you could say we look forward to bad weather. We enjoy the bad weather because we know there’s going to be salt used.”

Back on the surface, Bob Springer has gotten his wish… Cleveland has just been hit with a winter storm. At least a dozen trucks swing through the mine’s loading dock to pick up tons of salt. Later in the day, salt will be dumped onto barges and transported across the Great Lakes to places like Chicago and Toronto. This is high season for road salt. The crews here know that come March, they’ll start rousing salt from its ancient bed for the winter of 2006.

Scientists Keep Tabs on Exotic Crab

Scientists aren’t sounding the alarm yet. One Chinese mitten crab found near Quebec City doesn’t constitute an invasion. But if they reproduce, the critters could spread quickly.


David MacNeill is a fisheries specialist with New York Sea Grant. He says one was found in Lake Erie in the 1970s, but didn’t proliferate. The mitten crabs spawn in salt water, so they don’t really threaten the upper Great Lakes. But the St. Lawrence River may be better habitat. Regardless, MacNeill says the discovery highlights problems with foreign ships exchanging ballast water before they enter the Great Lakes system.


“Inside ballast tanks on ships, they’re like giant tidal mud flats. When you empty all the water out, there’s this large mud layer. Some of these organisms can burrow into the sediment which is what the mitten crabs do.”


In January, the Coast Guard conceded its ballast discharge rules don’t always work. It said it must find new ways to keep foreign invaders out of the Great Lakes.

New Pvc Plant Worries Environmental Groups

Environmental groups are protesting the construction of a new PVC plant near Buffalo. They say manufacturing PVC releases toxic chemicals into the environment. The group recently released a report highlighting the dangers of PVC and are calling on companies to phase out production of the popular manufacturing material. Mike Schade heads the Citizens’ Environmental Coalition in western New York. The region is home to CertainTeed, a PVC plant that will soon expand to a site along Lake Erie. Schade says it’s a step backward.


“I think it’s outrageous that, given the fact the Great Lakes have seen so many environmental problems, that CertainTeed is coming in and citing a PVC plant right on the lake,” said Schade, “It certainly isn’t my vision for a clean and safe and healthy waterfront.”


Schade says residents near other Certain Teed plants show increased levels of cancer and other serious disease. But company spokesperson Dottie Wackerman disputed the claims. And she says the company’s new plant will have virtually no emissions.

6,000 trucks cross the Blue Water Bridge every day between Canada and the United States. Just under the bridge, Lake Huron funnels into the skinny St. Clair River on its way to south to Lake Erie. The Blue Water Bridge connects Port Huron, Michigan with Sarnia, Ontario. This is the second busiest truck crossing between the United States and Canada. With post 9/11 security, the border can get backed up for miles in both directions. A lot of these trucks are carrying garbage back and forth across the border. Canadian trash and toxic waste is going to the U.S. and American toxic waste is going to Canada.


During her first month in office, Ontario Member of Parliament for Sarnia-Lambton, Caroline Di Cocco, found out just how much toxic waste was coming into her district.


“In 1999 that year, it was over 450,000 tons. To put it in perspective, the Love Canal was 12,000 tons.”


Di Cocco went on a five year crusade to change the Ontario laws that govern the trade in toxic waste. She adopted the U.N. resolution known as the Basel Agreement, as her model.


“The notion from that Basel Agreement is that everybody should look after their own waste and it is not a commodity.”


Di Cocco is not alone in her fight to slow or stop the flow of garbage and toxic waste from crossing the border. Mike Bradley is the mayor of Sarnia, Ontario. He can see the backup on the Blue Water Bridge every day from his home.


“One of the ironies on this is that while Michigan is very much upset, and rightly so, with the importation of Toronto trash, there are tens of thousands of tons of untreated toxic waste coming in from Michigan crossing the Blue Water Bridge into the Clean Harbors site.”


The Clean Harbors facility is the only place in North America that does not pre-treat hazardous waste before it dumps it into its landfill. Frank Hickling is Director of Lambton County Operations for Clean Harbors. He says imports from nearby states in the U.S. accounts for about forty percent of its volume.


“It’s from the Great Lakes area. We do reach down and take waste that our facility is best able to handle. We’re right on the border.”


Rarely do lawmakers on both sides of the border agree on an environmental issue. But pre-treatment of hazardous waste is the law in all fifty states, Mexico and every other Canadian province and territory except Ontario. Pre-treatment reduces the amount of toxic waste or transforms it into a less hazardous substance. But Hickling says disposing hazardous waste in Clean Harbors is a better economic bet.


“Obviously, if you don’t have to pre-treat it, it is cheaper there’s no doubt about that. But what isn’t obvious is the security of the site. Pre-treating waste doesn’t help immobilize the material forever.”


Clean Harbors’ company officials say their landfill won’t leak for 10,000 years. They say that the U.S. pre-treats hazardous waste because they expect their landfills to leak in hundreds of years or less. Hickling says the blue clay of Lambton County that lines Clean Harbors landfill gives them a competitive edge as a toxic dump.


“The facility is in a 140-foot clay plain and we go down about 60 feet. So there’s 80 feet below.”


But Clean Harbors has had big environmental problems. When volume was at its peak in 1999 the Clean Harbors landfill leaked methane gas and contaminated water. Remedial pumping of the landfill is ongoing.


Caroline Di Cocco found other ways to deal with toxic waste rather than simply dumping it in her district.


“First of all, there has to be a reduction of the amount of generation of this hazardous material. The more expensive you make it for industry to dispose of it, the more they are going to find creative ways to reduce it. Then there are what they call on-site treatments and closed-loop systems. You see technology is there but it’s expensive and again we go to the cost of doing business. And so a lot of the hazardous waste can be treated on site in a very safe way. And then what can’t be, well then you have to have facilities to dispose of it. But I believe that the days of the mega dumps have to end.”


Meanwhile, Clean Harbors looks at what the new Ontario regulations for pre-treatment will cost them.


“Certainly when you’re making the investment in pre-treatment and you’re adding all that cost for no additional environmental benefit we’re going to have to be getting larger volumes to ensure its profitability.”


Until we see a reduction in the loads of toxic waste that need to be dumped in Clean Harbors, it’s likely the trucks will roll on down the highway.
