Protection Agency. That’s the ruling of a California judge. The Great Lakes Radio Consortium’s

The ruling calls on the EPA to repeal a decades-old exemption for ballast water discharges from the

federal Clean Water Act. Discharges from ships’ ballast tanks have dumped foreign plants and

animals into coastal waters and the Great Lakes. The organisms have wreaked environmental and

economic havoc on native ecosystems.


Jordan Lubetkin is with the National Wildlife Federation.


“By this ruling, ballast water discharge is regulated as a biological pollutant. Ballast water is

treated like a discharge from an industrial facility, or a wastewater treatment facility, and in

this regard it’s no different.”


An EPA spokesman says the agency is reviewing the decision, and its options. The judge has ordered

an April 15th conference for the EPA and the environmental groups that sued to discuss how to move

forward.

A Michigan lawmaker is urging other states in the region to enter into a
multi-state compact aimed at limiting the influx of invasive species into
the Lakes. The Great Lakes Radio Consortium’s Sarah Hulett reports:


Federal regulations require ocean-going ships to exchange their ballast
water in the open ocean before they enter the Saint Lawrence Seaway. The
idea is to flush out any plants or animals that might have hitched a ride
from foreign ports. But Michigan state Senator Patty Birkholz says that
system isn’t working, because organisms can remain in the sludge at the
bottom of ships’ ballast tanks.


Birkholz is the co-chair of the Great Lakes legislative caucus. She wants
the eight states that surround the lakes to use their water pollution laws
to crack down on ships that release ballast water into the lakes.


“So it would require, first of all, them to get a permit to prove that
they’ve treated their ballast water, and then to treat their ballast water
in order to enter the Great Lakes basin.”


Birkholz hopes to have a multi-state compact in place by 2007.

U.S. Forest Service show that the agency isn’t doing its job.

The group Public Employees for Environmental Responsibility – or
PEER – cites 44 cases over the last two years in which the Forest Service violated
environmental laws it’s supposed to enforce. PEER cites an internal Forest Service memo. It details instances in which the agency had to pay attorney fees to environmental groups that
successfully sued over issues like illegal logging and over-grazing on forest lands.


Jeff Ruch is the executive director of PEER. He says during the
Clinton
Administration, there were only a handful of adverse rulings each year.


“And they’re now losing these cases at a greater rate than two a month. So
roughly every 10 days, the Forest Service is found guilty of violating a law
they’re supposed to be implementing, in a federal court.”


But a spokeswoman for the Forest Service says a closer look at the
rulings
shows a different picture. She says almost half the cases cited by PEER were
based on decisions the Forest Service made prior to President Bush taking
office.

But scientists are learning more and more about
another type of pollution that can reach harmful
levels even in the winter months. And as the Great
Lakes Radio Consortium’s Sarah Hulett reports… we
might be hearing more about this type of pollution in
our daily weather reports:

In the summer, local weather forecasts often include information about dangerous ozone levels. But scientists are learning more and more about another type of pollution that can reach harmful levels even in the winter months. And as the Great Lakes Radio Consortium’s Sarah Hulett reports, we might be hearing more about this type of pollution in our daily weather reports:


Parts of the region recently reached “code red” for poor air quality. And
that had some people perplexed. Warnings about dangerous levels of ozone are
frequent on hot summer days, especially in urban areas. But this was the
middle of winter.


The warnings were for high levels of tiny particles that federal regulators
only recently began monitoring. They’re spewn from diesel engines,
factories, power plants, and fireplaces. Air monitors in Michigan,
Minnesota, Pennsylvania, and Indiana recently registered unhealthy levels of
these particles – some of them for a few days straight.


Jim Haywood says the problem was an unusual weather event for this time of
year. Haywood is a meteorologist with the Michigan Department of
Environmental Quality. He says a high pressure system moved very slowly over
the Great Lakes region for several days. When you get high pressure, the air
below sinks, generating a layer of warm air that acts like a lid.


“So that warm air that was sinking effectively stops at a few hundred feet
from the surface of the ground. It acts like a cap. It does not let any of
the pollutants that are released at the surface pop up through that cap.”


So all the pollutants that would have gotten picked up and diluted by the
wind instead just hung out for days – building up, and reflecting sunlight
to create haze.


Eventually, a cold front pushed the high pressure system out of the way, and
took the pollution with it. But what about those few days when the Environmental Protection Agency was warning about unhealthy levels of particulate pollution? For people with
heart or lung disease, agency health officials say short-term episodes can
lead to asthma attacks or even heart attacks. And they say healthy children
and adults can experience throat and lung irritation.


Susan Stone is an environmental health scientist with EPA. She says
particle pollution warnings could soon become a staple of the daily weather
report – much like the familiar summer ozone warnings.


“With ozone, we have the network in place to be able to deliver those
forcasts, people are used to hearing that on TV, and we are working to
provide that same level of coverage for particle pollution.”


Stone says EPA is rolling out a new program called Enviro-Flash
nationwide. It sends real-time air quality information to people’s email
accounts or pagers. EPA is offering the service through state
environmental agencies. And beginning in 2010, areas that register
unacceptable levels of particle pollution will be required to clean up their
air.

Many cities looking to revitalize their urban centers
have turned to greenways to spur economic development. Greenways are pedestrian or bike paths that typically run between parks, museums, or shopping districts. The Great Lakes Radio Consortium’s Sarah Hulett reports on hopes that greenways will breathe new life into one of America’s most blighted urban landscapes:

Many cities looking to reviatlize their urban centers have turned to greenways to spur economic development. Greenways are pedestrian or bike paths that typically run between parks, museums, or shopping districts. The Great Lakes Radio Consortium’s Sarah Hulett reports on hopes that greenways will breathe new life into one of America’s most blighted urban landscapes:


This abandoned rail line twenty-five feet below street level might not be many peoples’ first choice for a walk or a bike ride. But Tom Woiwode thinks soon it might be. Woiwode is the director of the GreenWays Initiative for all of Southeast Michigan. When he takes a look down this former Grand Trunk Western Rairoad line in Detroit, he doesn’t see the fast food wrappers, tires, and crashed and rusting shopping carts. He sees trees and grass and benches. And more importantly, he sees people, and places for people to spend their money.


“So maybe a bike repair shop, restaurants, some opportunities for music venues and those sorts of things, so people can ride their bike on down to the riverfront and along the way either stay here for lunch, or along the way stop and rest and enjoy the ambiance, or take their food and go on down to the riverfront where they can enjoy the extraordinary natural resources of the river as well.”


We’re standing near the city’s sprawling open-air produce market. It’s one of the most popular draws for people from inside and outside the city limits. When it’s complete, the greenway will link the market to Detroit’s greatest natural asset: the Detroit River. Greenways are a new redevelopment concept in Detroit. But elsewhere, Woiwode says, they’ve proven a well-tested urban redevelopment tool.


“In fact, back in the late 90’s, the mayors of Pittsburgh and Denver – two municipalities that are roughly similar in size to Detroit – both characterized their greenways programs as the most important economic development programs they had within the city.”


Minneapolis is another city that’s had success with greenways. In fact, backers of the greenway plan in downtown Detroit say they were inspired by a similar project there. Last month, Minneapolis completed the second phase of what will eventually be a five-mile greenway along an abandoned rail line much like the one in Detroit. It’s called the Midtown Greenway. And it’ll eventually link the Chain of Lakes to the Mississippi River thruogh neighborhoods on the city’s south side.


Eric Hart is a Minneapolis Midtown Greenway Coalition board member. He says even the greenway’s most avid supporters joked that people might continue to use it as a dumping ground for abandoned shopping carts like they did when it was just a trench.


“Since then, since it was done in 2000, there’s been a lot of interest in the development community to put high-density residential structures right along the edge of the greenway. And it’s viewed more like a park now.”


Since the first phase was completed in 2000, one affordable housing development and a 72-unit market-rate loft project have been completed. And five more housing developments – mostly condos – are in the planning stages. Hart says people use the greenway for recreation and for commuting by bicycle to their jobs.


Colin Hubbell is a developer in Detroit. He says he’s all for greenways, as long as they’re not competing for dollars with more pressing needs in a city like Detroit: good schools, for example. Or safe neighborhoods. Hubbell says the question needs to be asked: If you build it, will they come?


“I’m not sure. I’m not sure, if, given the perception problem that we have as a city, how many people on bikes are going to go down in an old railroad right away, I’m not sure even if that’s the right thing to do, given the fact that – I mean, we have a street system. And just because there’s a greenway doesn’t mean if somebody’s on Rollerblades or a bicycle that they’re not going to stay on a greenway.”


Hubbell says Detroit already has a lot of streets and not much traffic – leaving plenty of room for bicyclists. Hubbell says it might be cheaper to paint some bike lanes, and put up signs. But he says connecting the city’s cultural and educational institutions, the river, and commercial districts with greenways is a good idea – as long as they’re running through areas where people will use them.


Kelli Kavanaugh says that’s exactly what’s happening with greenway plans in the city. Kavanaugh is with the Greater Corktown Economic Development Corporation in southwest Detroit.


“You can’t just stick a greenway in the middle of a barren, abandoned neighborhood and expect use. But when you put one into a growing neighborhood, a stabilizing neighborhood, it really works as another piece of the quality of life puzzle to kind of support existing residents, but also attract new residents to the area. It’s another amenity.”


Greenway backers say for a city struggling just to maintain its population, Detroit can only benefit from safe, pleasant places to walk and bike. And if other cities are any indication, they say greenways should also help bring another kind of green into Detroit.

Representatives from about 75 Native American communities in the U.S. and Canada are demanding a more prominent role in the decision-making process for the agreement known as Annex 2001. The agreement aims to limit Great Lakes diversion. But many tribal groups say the draft agreement is weak.


The Council of Great Lakes Governors says it plans to invite tribal groups to a forum shortly after the New Year. Frank Ettawageshik is the tribal chair of the Little Traverse Bay Bands of Odawa Indians, in northern michigan. Ettawageshik says he has yet to see the offer. But he says tribal governments don’t just want to be consulted as Indian communities.


“Of course, the governments are made up of many communities. But it’s not just a matter of wanting community input. It’s a matter of wanting input at a government-to-government level.”


The Council of Great Lakes Governors is handling Annex negotiations. The eight governors and two premiers are expected to sign the agreement sometime next year.

Observeers say the objections won’t sidetrack negotiations on the agreement known as the Great Lakes Charter Annex. The Great Lakes Radio Consortium’s Sarah Hulett has this report:


The Charter Annex would give the eight states and two provinces that surround the Lakes a say in how much water can be diverted out of the Lakes to other regions. But Ontario officials say they don’t think the current draft goes far enough to protect the Lakes. David Natzger is with the Council of Great Lakes Governors, which is coordinating negotiations bewteent he states and provinces to implement the Annex. Natzger says the announcement reflects healthy debate, and not a snag in the process.


“I think it says that there’s a lot of interest in this issue in Ontario, and certainly there were some concerns that were raised in the public comment period, and they will be taken into consideration as changes are considered and made, ultimately.”


In January, the staffs of the Great Lakes governors and premiers plan to start negotiating changes to the Annex. Natzger says the changes will reflect some of the concerns brought forward in ten-thousand public comments.

Report: Big Mercury Reductions Are Affordable

According to a report by the National Wildlife Federation, steep reductions in mercury
emissions from coal-fired power plants in the Midwest/Great Lakes region can be achieved

The report looked at coal-fired plants in Illinois, Michigan, Ohio, and Pennsylvania.
It says 90 percent of mercury could be stripped from power plant emissions using available
technology, at a minimal cost. Zoe Lipman is with the National Wildlife Federation. She says
the benefits to public health would be quickly realized.


“When you cut mercury emissions, you see reductions in mercury in water and fish in a matter
of years, not decades.”


The National Wildlife Federation report looked at the cost of outfitting power plants with
a technology that uses carbon powder to capture mercury, and catch it in a fabric filter.
Utility companies say there’s no proven technology that strips mercury completely. They say
the technologies they’ve reviewed are more costly than what’s laid out in the report.

A new report says the U.S. Environmental Protection Agency lacks the information it needs to assess the overall health of the Great Lakes. The Great Lakes Radio Consortium’s Sarah Hulett reports:


A water quality agreement between the U.S. and Canada requires the two countries to reduce pollutants in the lakes and monitor progress in restoration.


But the Government Accountability Office report says coordinated monitoring between the two countries has not been fully developed. The GAO is the investigative arm of Congress. The reports says disparate agencies – at the federal, state, provincial and local levels – are monitoring the lakes, but it says information from those groups does not provide an overall assessment of the lakes. The GAO is recommending that EPA develop a system to ensure complete, accurate and consistent information.


In its response to the report, EPA said it agreed with that recommendation and is taking steps to coordinate, monitor, and develop standards for measuring the health of the Great Lakes.

More and more Americans are being warned that the local fish they eat could be
contaminated with mercury and other toxins, according to a new report by the U.S.
Environmental Protection Agency. The Great Lakes Radio Consortium’s Sarah Hulett

The EPA report reflects the number of state-issued fish consumption advisories. And
according to those advisories, more than a third of the nation’s lakes, and close to a
quarter of its rivers contain fish that could be contaminated. In addition to that, 100
percent of the Great Lakes and its connecting waterways are covered by fish consumption
advisories.


EPA officials say the increased warnings reflect better monitoring by states, and not
increased emissions.


But environmental groups are using the data to attack the Bush administration’s proposed
new mercury emission rules as doing too little, too late. Ed Hopkins is with the Sierra
Club.


“I’m sure that everyone would like to see mercury emissions reduced sharply, so that fish
are safe to eat again.”


The EPA is expected to issue new rules for mercury that would require coal-fired power
plants to reduce their emissions by 70 percent by 2018. By contrast, the Clinton
administration called for a 90 percent reduction by 2008.
