The EPA says it has a duty to regulate greenhouse gasses to protect us from global warming.

The state of Texas, Virginia, and Alabama have filed legal challenges to try to stop the EPA. They say the coming regulations will be bad for the economy. And they call into question the science that EPA based its decision on.

Here’s the Texas attorney general – Greg Abbott:

“The information on which the EPA relies can neither confirm nor deny that there has been global warming, or that temperatures have risen.”

The EPA says it’s evaluated all the science available for the last ten years, and that the evidence is quote “compelling” that climate change is real – and that it’s a threat to human health and welfare.

Those three states challenging the EPA’s decision to regulate greenhouse gases are countered by sixteen other states supporting the EPA’s decision.

Mountaintop Mining Protest

When the West Virginia Coal Association heard about plans for a rally to protest mountaintop removal coal mining, it issued an email. The Associaiton wanted supporters of the coal industry to hold a counter protest to the quote, “liberal enviro-whacko’s rally.”

The coal mining supporters not only showed up, but they brought in some big trucks, horns blaring to try to disrupt the protest speakers at the rally in front of the offices of West Virginia’s Department of Environmental Quality.

The Coal industry’s message was simple. Coal means jobs. Jobs mean paychecks.

But the protestors against mountaintop removal coal mining say there are more important things.

One of those speakers was Maria Gunnoe. She’s a coal miner’s daughter who’s worked against the environmental damage of blowing off the tops of Appalaichan mountains to get to the coal. The blasted debris has been dumped into valleys, damaging streams and water supplies.

“I challenge you. You think it’s hard to live without a paycheck? Try living with nothing to give your children to drink. Paycheck’s not important when you don’t have water to give your children.”

Maria Gunnoe has been there. She lives in a valley just downhill from a debris fill. She testified against the coal companies in a court case to stop them from dumping debris in streams. Let’s just say she’s not a popular figure among the pro-coal folks.

Bo Webb lives in Coal River Valley. He’s one of the organizers of the rally opposing mountaintop removal coal mining. He scheduled the protest the same day climate talks in Copenhagen started. He’d liked to see the people where he lives get something from those negotiations.

“I’m hoping what comes out of Copenhagen for here would be a message that some of these miners could start understanding and stop manipu- allowing- themselves to be manipulated by a coal industry that’s got one concern, and that’s profits.”

At the counter-rally, many of the coal mining supporters did not want to talk to news people. One guy who would talk is Gary Finley. He’s from Ohio and sells equipment to the coal mining industry.

“You know, this industry is regulated, heavily regulated, now. It has been since, what, 1977? (Yep.) So, you know, we’re doing everything that’s dictated by law in the mining of coal.”

When asked about the future of coal, Finley hesitated.

“Well, (laughs) right now I’m uncertain. I can tell you what I hope it’ll be. I hope it continues. You know, we’ve got a lot of coal in these mountains. I don’t believe the people in this country realize how important coal is to the economy of the eastern United States, people realize when they go into their homes and turn on their light switch and the electric comes on, if we don’t mine coal, that’s gonna be- it’s done.”

The protest was a lot of passionate speakers, a lot of booing, and a lot of truck horns.

But what irritated the coal mining supporters more than anything seemed to be the idea that outsiders were coming to West Virginia to tell them what to do. And the liberal outsider that aggravated them most was environmentalist Robert Kennedy, Junior. Kennedy calls fossil fuels a deadly addiction that’s wrecking the country, and says mountaintop removal coal mining is destroying communities.

“And, you know, we need to figure out ways to power our country that don’t compromise the aspirations of future generations, don’t compromise their potential for prosperity, for wholesome, dignified communities.”

In the end, nothing was settled in West Virginia, just as nothing will be settled in Copenhagen.

But at the local level and the international level, people are talking about fossil fuels differently. Some see a bright future in renewable, sustainable energy and preserved forested mountains, while others feel their lives and their livelihoods threatened.

Mari-Lynn Evans and Phylis Geller set out to make the movie Coal Country
because they wanted to show how different people are affected by coal
mining.

They found lots of activists, and regular citizens, who would talk with
them. Plenty of people were willing to show the thick black water in their
toilet tanks. They wanted to show the black soot covering their cars.
They wanted to talk about the health problems they live with. And they all
blamed the coal industry.

Evans also wrote to coal supporters – to get their side of the story on
camera. The answer?

“No. That was their response. I sent out requests to the coal industry,
to coal companies and to suppliers of the coal industry.”

Evans brother is a coal miner. He supports mountain top removal.

As we see in the movie, that’s when coal companies blow off the entire
top of a mountain to get to the coal. Many people consider it the most
polluting and environmentally devastating type of mining.

But Evans says not even her own brother would do an interview about it.

“And when I said, ‘why won’t you talk on camera? You feel so
passionately that coal is wonderful and mountaintop removal is actually for
the environment as well as the economy.’ And his response to me always
was, ‘oh I would never speak on camera without getting permission from
the company I work for.’”

The filmmakers heard that a lot. And no coal miners ever did get
permission to talk on camera.

In the movie, we do hear from Don Blankenship, head of Massey Energy. He
spoke at a public hearing about the need to ease environmental restrictions
on coal mining.

“We had nearly 800 employees up ‘til Friday. We had to lay 8 off. I
think that might be just the tip of the iceberg if we don’t our rules
changed how we mine in the state.”

Anti-coal activists at the public hearing explain how the coal companies
use that kind of intimidation to control miners.

“I think people are scared that they will lose their jobs and be flipping
burgers. You look out and that’s all you see. You see mining and
flipping burgers. And, I argue, that the coal companies want it that way.
They want that to be the only option. That’s the only way they could get
support for how they treat their workers and how they treat this land.
This would never happen in a place that wasn’t poor. Never.”

In the movie, some coal miners stand up at the public meeting to defend the
companies they work for. One explains the coal industry has provided him a
good salary.

Miner One: “For the last 14 years, the coal industry has supported myself
and my wife and my 3 children.”

Miner Two: “When the last one of you so-called environmentalists leave
the state, when the rest of us leave for North Carolina, turn out the
lights. Oh, wait a minute, there won’t be no lights. No coal, no
lights.”

The filmmakers want more Americans to understand that when we flick on a
light switch – it is not a meaningless act. It takes electricity. And
that takes coal.

And, as anti-coal activist Judy Bonds says in the movie, coal is tearing
apart West Virginia.

“It is a civil war; it’s families against families. It’s brother
against brother.”

Or – in the case of filmmaker Mari Lynn-Evans – brother against
sister.

Gary Anderson takes me out on his back porch and all you can see is Coal River Mountain. Even on a cold, gray winter day, it’s beautiful.

“All of that mountain range of there, that is Coal River Mountain– that mountain runs for about 3 miles up there.”

When he retired, Gary and his wife Barbara moved from Connecticut back to her family home in Colcord, West Virginia.

“That’s basically what brought us back. Is the mountains and the beauty. We grew up here and we came back to spend the rest of our days here. We thought were coming back to what we remember– the beautiful mountains. And really they just started doing the mountaintop removal over here in the past couple years.”

Other mountains in the area– Cherry Pond Mountinan and Kayford Mountain have been flattened so energy companies could get to the coal inside them.
Over one million acres in West Virginia, Virginia, and Kentucky have already been leveled to mine the thin vein of coal.

The mining companies dynamite the tops off to get to the coal underneath.

“Once in awhile you’ll see a big puff of dust go up in the air like a bomb has been dropped and in awhile it will settle down and then it will happen again the next day.”

Mountains are shorted and flattened–- often by 100’s of feet to get to a 14-inch seam of coal. What the dynamite loosens is dumped in the valleys. Thousands of miles of streams have been covered over and nature destroyed.

It’s pretty simple. They put dynamite in the mountain and blow it up.

Joe Lovett is the Executive Director of the Appalachian Center on the Economy and the Environment. He’s been fighting mountaintop removal for the past 10 years.

It’s like a layer cake. The mountain is like a layer cake and that coal is the icing. The dirt and rock in between is the cake. There is a lot more dirt and rock and mining waste than there is coal. And when they blow up the mountain the dirt and rock swell. So they have even a bigger problem because they have more material than they know what to do with. So, as they blow the mountain up they need to find something to do with the dirt and rock and they dump it into the streams and the valleys.

Dumping into streams was stopped. The Surface Mining Act’s Stream Buffer rule protected the streams. But the new Bush administration rule changes that.

Joe Lovett says that Coal River Mountain fair game for Massey Energy to blow the top off and fill the valleys.

“We have always believed that the rule prevented these fills, that and I guess so did the coal industry and the Office of Surface Mining because this has been the main thing that the coal industry has wanted from the Bush administration for a long time is that change in this rule.”

Lovett says its not good for the environment and it’s not good for the local economy.

“We are taking mountains that could support sustainable timber jobs for generations and, in a few short years, destroying them forever and mining them in such a way that those forests will never come back.”

The mining industry argues that we need this inexpensive energy source in order to be energy independent. But, says Lovett and other environmentalists, if valley fills were outlawed tomorrow the cost of coal for our electric rates would only go up by pennies.

I’ll also talk to an official of the mining industry about why this type of mining needs to continue. The fact it provides American energy and jobs and that West Virginia’s economy depends upon it.

Back at Gary Anderson’s home, he wonders how it came to this.

Who gave them the right to blow the tops of mountains off to get the coal? I mean, that’s what gets me. Where, back in time, did they get the permission to come in and just below the mountains up? It’s really unbelievable. You can’t go back and reconstruct a mountain that’s been here for hundreds of millions of years. Once they’re gone, they’re gone.”

But, the mining companies now have the legal right to level the top of Coal River Mountain and fill up the valleys and streams above Anderson’s home.

Coal River Mountain is one of the last in Raleigh County West Virginia, and it’s next in line for mountaintop removal mining. A local group, the Coal River Wind Project, wants to build a wind farm along the mountain’s ridges.

Lorelei Scarbro has lived most of her life in the West Virginia coal fields. She’s the daughter, granddaughter and widow of coal miners. She knows her opposition to coal mining is seen by her neighbors as a direct threat to their jobs.

“It has been difficult. But people begin to understand that we’re not trying to take something away from them. You’re trying to add something to the area.”

She says mountaintop removal coal mining is short-term gain with long-term damage.

“The pace we’re going; it will be nothing left. I have a five-year-old granddaughter, and I can’t imagine what the air and water will be like when she is at childbearing age if we continue at this pace, because they’re covering headwaters streams, they’re starving off the water supply, they are destroying the air.”

And the next mountain in Scarbro’s home area to be mined is likely Coal River Mountain.

That’s why Coal River Wind Project commissioned a study to see if wind turbines would work. It turns out, the mountain has industrial strength wind. Enough to power 164 turbines. The project would create 200 local jobs during construction, and 40 permanent jobs. Rory McIlmoir is the project coordinator.

“The wind farm would generate an average of $1.74 million a year for the first 20 years. In year one it would generate over three million dollars. That’s the property tax. Blowing up the mountain for coal, on the other hand, would only bring $36,000 back to the county.”

That’s just the property taxes. The wind farm would make about $1.75 million dollars a year in revenue according to the study.

But the wind project has hit a stumbling block. A recent Bush administration rule change allows mining waste to be dumped into streams. That’s cleared the way for the West Virginia Department of Environmental Protection to approve a permit for Massey Energy to do mountaintop removal mining here. If the mining occurs, the mountains would be lowered by several hundred feet. That would scrap the wind turbine project.

Activist Lorelei Scarbro thinks the wind project is the one thing that can stop the destruction of Coal River Mountain and others targeted for mountain top removal coal mining.

“It will save the mountains, it will save the wildlife and the hardwood forests and the vegetation and the water. It’s something that is desperately needed. Of course, our biggest obstacle is the fact that that the land is leased to the coal company.”

But the people who own the land say, if coal mining were stopped by the government, they’d consider the wind farm. The wind farm project coordinator, Rory McIlmoir, says they’d benefit for a lot longer if they did.

“Because, if they can make a few million each year from royalties then they’re interested in that. But, the choice right now is easily coal.”

The Coal River Wind Project has presented the study to West Virginia’s Governor. And 10,000 people signed a petition asking the state to think beyond coal and think about the future of energy, the economy, the mountains and the people.

Preserving Indian Mounds

Historians, archaeologists, and Native American tribes are fighting to save ancient
mounds. The mounds are found scattered across much of North America. These
earthen, man-made formations mark the presence of prehistoric, indigenous people. But,
Brian Bull reports many are disappearing because of development or neglect:

Jay Toth is walking through the Kingsley-Bend Indian Mounds site. Toth is an
archeologist with the Ho-Chunk tribe in Wisconsin. He surveys nearly 30 mounds here,
including several that he says contain human remains. Toth says these mounds range
from 800 to 2000 years old, and are considered sacred, which is why Toth isn’t happy
when a man lets his dog use one for a bathroom:


“There’s a sign right there…”



“The guy saw the sign coming in, he didn’t bother…think that’s a good reflection on why
mounds are continually destroyed. There’s just no consideration.”


The tribe has painstakingly restored and maintained this site with its own money. But
Toth says out of 20,000 groups of mounds across Wisconsin alone, only a quarter
survive today. Many are still being desecrated or destroyed by construction and
development:


“It’s just too bad that we don’t have the respect for the religious aspects of what these are
all about. No one would expect the Ho-Chunk Nation or
any other tribe to go in and buy up public cemeteries and subdivide it up for housing
development, but somehow mound sites and other native burial seem to be okay.”


And it’s not just in Wisconsin. Similar problems exist for Indian mounds in other states,
including Ohio, Illinois, Minnesota, and Tennessee. Development is supposed to stop if a
mound is discovered, but authorities can only act on the calls they receive.


Samantha Greendeer is a Ho-Chunk attorney. She’s working with tribal, state, and federal
officials to revive legislation first introduced by West Virginia Congressman Nick Rahall.
It would proactively protect burial mounds, rather than after they’re disturbed:


“We seem to have to deal with this a little bit more just because a lot of the old ancestral
mounds and burials of native people are not in organized European-type cemeteries that
are zoned and properly accounted for. They don’t get that extra
bit of protection that a normal burial site would get.”


If passed, the federal government would have to deal with Native American and Native
Hawaiian tribes before taking action that would affect any land deemed sacred. Attitudes
about the mounds are changing.

Construction workers are tearing up old concrete foundations, to help set up new
buildings on the University of Wisconsin campus. But it’s a different story near the
University observatory. Campus developers plan to displace newer structures with the
older architecture. Gary Brown points to a sidewalk built in the 1950s. It’s right next to a
centuries-old bird effigy mound which some Native Americans still use for ceremonies:


“We’ll be coming back several feet away from the edges of the mound, carefully remove
the sidewalk, reconstruct the sidewalk a little bit further away. It’ll be a lot of hand labor,
there won’t be a lot of major big machinery…”


And moving the sidewalk will create a buffer zone to help protect the ancient mound.



Some people outside of the tribes realized the value of the mounds decades ago.
Roger and Margaret Martin walk in the rain with umbrellas, to show several effigy and
burial mounds in their backyard:


“When friends come to visit, we take ’em out back and point them out…We’re standing
on the bird effigy, swept back from both sides are the bird’s wings…the one on the left is
much more pronounced.”


Back when the neighborhood was being built, most people flattened the mounds. But, he
Martins signed up with what’s called an archaeological covenant program. They’ve
promised not to alter the mounds on their property. They also get a tax break on any land
containing a mound.


The Martins say they’d like to begin a ceremony where they visit the mounds and think of
their makers, the early North American cultures. Such reverence means a lot to Ho-Chunk
archeologist Jay Toth, who says the formations are rich in meaning and history for his
people:


“These mounds represent the deed to the land for all Native Americans. This you can’t
take away.”


Toth and other preservationists hope Congress passes laws to better protect ancient
mounds. They hope in time that people come to regard both burial and effigy mounds as
items to preserve, rather than destroy.

for rats pouring out of the sewers in droves all over the country, and the nasty vermin are relocating to some of the most pristine
neighborhoods. The Great Lakes Radio Consortium’s Joyce
Kryszak explains what caused the rat invasion and
what’s being done to evict them:

Unusually heavy rains this summer are partly to blame for rats pouring out of the sewers
in droves all over the country. And the nasty vermin are relocating to some of the most
pristine neighborhoods. The Great Lakes Radio Consortium’s Joyce Kryszak explains what
caused the rat invasion and what’s being done to evict them:


Piercing blue autumn skies and billowing white clouds drift across the chimneys of this modest,
but perfectly manicured suburb. There aren’t even many leaves crunching under foot. Town workers
have already come and vacuumed them all away. But there’s a nasty little secret scurrying under
the porches and behind the garden sheds in this Western New York town. County Sanitation Chief
Peter Tripi takes us for a peek.


“Can you see the teeth marks here? That’s actually rat gnaw marks. And there’s the garbage bag.
And that’s what we found when we went to this property.”


Now, you might be thinking that we trudged through derelict grass and scattered debris to find
these rat clues. Nope. This is a gorgeous, manicured yard – with not a blade of grass out of
place. But Tripi says rats aren’t choosy.


“You would never think by looking side to side that there would be a rat problem in this yard.
Doesn’t matter what neighborhood you live in, or how much money you’ve got. There’s no difference.
They just like your food.”


And you’d be surprised where rats can find food. A garbage can left even briefly uncovered, a
neglected bird feeder, uhhh… dog feces… and even a compost pile.


“Absolutely. This is a rat condo. It’s a grass-clipping compost pile that basically housed rats
to go a hundred yard radius all the way around to the different houses.”


Tripi says rats had to get creative with their housing. A summer of extremely heavy rains drove
the out of the sewers and into some previously rat-free neighborhoods. And with the West Nile
virus killing off millions of birds, the rats have less competition for the food they’re finding
above ground. The consequence is a virtual rat infestation all the way from New York and Illinois
to Virginia, Michigan and L.A. In Kenmore, there have been four thousand rat complaints – nearly
double last year.

Of course, none of this is news to the garbage collectors. They see the problem up close and
personal. Twenty-year veteran Louie Tadaro says this past summer is the worst he’s ever seen.


“Across the street there’s an alleyway and there had to be like ten of them in there, And we
started chasing them with garbage cans trying to kill them, but we couldn’t. By the time we
got there they just split.”


The problem is, they don’t split for long. Vector Control Chief Tripi says now that the rats
have relocated from the sewers to upscale accommodations, they kind of like it.


“And what that means is that they want to live with us. They want to be near our garbage and
our bird feeders. The problem with that is that rats carry diseases.”


We all know about stuff like typhus and the bubonic plague. But there are emerging diseases,
such as a pet-killer called Leptospiroris. It’s killing dogs all across the country. Tripi
says they need to get rid of the rats before the disease starts spreading to humans. So, his
team is taking the rats on, one yard at a time.


Tripi and his Vector control team set rat traps, they fill bait boxes with poison, and – when
they have to – they issue citations to residents who don’t heed the town’s new “rat control rules.” Covered garbage cans only. Clear away all brush. Clean up scattered bird seed and dog feces. Slowly, the rules seem to be working.

Still Tripi says it’s mostly educational warfare. And he says now – heading into winter – is the
best time to nip the problem. If the rats get cozy, not only will they stay, they will multiply.
Fully nourished, one adult rat can breed up to sixty baby rats a year.


“The adult rat can live on a little bit of food, but he can’t procreate unless he has a lot of
food source. And they can’t live through the winter unless they’re warm and fattened up.”


So now is the time to – quite literally – put a lid on it. Keep those garbage cans covered, unless
you want some uninvited furry guests this winter, and many, many more come spring.

Emissions Trading for Telecommuters

Companies who fear that their greenhouse gas emissions may soon be regulated are being
offered a new alternative. A Virginia-based firm has created an emissions trading system
that will capitalize on telecommuting. The Great Lakes Radio Consortium’s Karen Kelly
reports:


The company is called “Teletrips.” And it’s created a system in which industries that
need to reduce their emissions can buy credits from businesses with large numbers of
telecommuters.


Teletrips president Mary Beatty says the trading system would force polluters to buy
credits to offset the amount they pollute. They’d buy the credits from companies who
keep their employees off the road.


“We felt like if you could find an incentive that would motivate companies to set up
(programs) trip reduction programs and (be able to quantify that) and give them some real
financial benefit back for creating those programs, that was much better than mandating
an approach.”


The company’s software converts the number of trips saved by working at home into the
amount of emissions averted.

Scientist Tracks Air Mysteries

The Great Lakes region is home to major power producers. But along with the electricity they make comes some amount of air pollution. When coal-fired power plants in Illinois and Ohio emit sulfur dioxides, prevailing winds blow them to the Northeast, where they can fall as acid rain. Several northeast states are suing those power plants to clean up their emissions. Earlier this summer, a professor at Clarkson University in northern New York coordinated a unique study to learn more about the life cycle of air pollution, from where it’s produced to where it lands. The Great Lakes region is home to major power producers. But along with the electricity they make comes some amount of air pollution. When coal-fired power plants in Illinois and Ohio emit sulfur dioxides, prevailing winds blow them to the Northeast, where they can fall as acid rain. Several northeast states are suing those power plants to clean up their emissions.


Earlier this summer, a professor at Clarkson University in northern New York coordinated a unique study to learn more about the life cycle of air pollution, from where it’s produced to where it lands. The Great Lakes Radio Consortium’s David Sommerstein has the story.

Chemical engineering professor Phil Hopke will take any opportunity to get out of his office and over to his field lab. It consists of a concrete slab amongst the weeds in a corner of the local airport. Installed on the concrete are monitors he uses to find out exactly what’s in the air we breathe.

Hopke unlocks a gate in a chainlink fence. You can already hear a strange hum in the distance. It gets louder as Hopke strides up to one of three white machines the size of dishwashers.


“Come out and change the filters once a day. This one’s for organic constituents in the air.”


He pulls out what looks like an air filter for your furnace. These machines suck in air. They leave a unique footprint of chemicals on the filter that represents what was in the air in this place on this day — chemicals like sulfur dioxide and mercury. Hopke will send these filters to specialty labs around the world to be analyzed.


There are hundreds of stations like this in North America. Groups of researchers study daily air quality for every region of the country. They examine how things like traffic and smokestacks might affect the air we breathe.


But Hopke says they mostly focus on their own areas. They don’t often coordinate studies to see how the chemicals they find move from region to region.


“It struck me a couple of years ago, particularly in the Northeast, that we have these groups talking to one another.”


Working with the U.S. Environmental Protection Agency, Hopke convinced 26 sites in the East, from Texas to Toronto, to measure the same stuff on the same days. They chose the whole month of July.


It’s perhaps the largest simultaneous air sampling effort ever conducted in this country. When the data’s complete, the study will track the lifespan of pollution, from when it leaves a smokestack or a car’s tailpipe to when it is taken up by a tree or your lungs.


But scientists can’t just follow one molecule of pollution from a car in St. Louis to a lake in Michigan. They have to make models of how the chemicals move, like how meteorologists make weather maps to trace storm systems. As if that’s not complicated enough, says Hopke, naturally occurring chemicals make the job even tougher.


“You have to keep in mind that the Blue Ridge Mountains in Virginia are blue because of natural photochemical smog, particles being formed because of the pine materials that come off. Those materials that you smell are chemically reactive and will undergo the same type of smog reactions as human emitted materials.”


So researchers use techniques to separate out the “man-made” pollutants from the “natural” pollutants. Next they look for high concentrations of, say, sulfur dioxide in Chicago on July 15th. Then they follow those high levels east with prevailing winds. They look for high sulfur dioxide levels in Ohio or New York a few days later. After doing this many times in July for many types of chemicals, the researchers hope patterns will begin to emerge.


Hopke sits on a scientific advisory committee that helps the EPA develop pollution standards. He says this coordinated study will bring stronger science to the EPA’s sometimes controversial decisions.


“Suppose I require all power plants to reduce their sulfur dioxide emissions by twenty percent. What does that do for me for particle concentrations in New York City? What will that do? Will that get us where we want in terms of clean air?”


With a study this large in scope, the answers to those questions won’t come quickly. The massive amount of data gathered in the study will take a few years to interpret.


In the meantime, Hopke and the EPA are planning another cooperative sampling effort for wintertime, when temperatures and people’s habits are different from summer.
