Checking in With the Department of Environmental Quality

As the year winds down, we’re spending some time this week on The Environment Report taking a look at the state of our environment. On Thursday, we’ll hear from the Michigan League of Conservation Voters on just how well they think Governor Snyder has been protecting Michigan’s natural resources. But, first, today, we speak with the man whose job it is to keep your environment healthy. That would be Dan Wyant, Director of the Michigan Department of Environmental Quality.

Cutting the DEQ’s Budget

I first asked Wyant about his department’s budget. It’s been cut and cut over the past decade; just this year alone it saw a 15 percent cut. The cuts do have an impact, says Wyant, but, “it’s forced [the department] to prioritize… think about what we want to accomplish. So, we’re focused around air quality and water quality and public health… and I think we can say, with some confidence, that we are seeing more environmental stewardship, not less.”

Economic Development

Governor Snyder has said one of the goals for the DEQ is for the department to be a part of Michigan’s economic development. Both Snyder and Wyant believe the DEQ has a role in the state’s recovery. “We know that it’s our role to ensure good environmental stewardship – that’s why we were created and that’s our job,” notes Wyant. But, he also says he thinks there are certain things the department can do to help businesses grow in the state. “We want to be recognizing permit timing so that businesses can get timely decisions and… we’re looking at old and antiquated, duplicates of regulation… and we want to address culture. We want to be a department of problem solvers. It doesn’t mean that we don’t wear the black hats and that we don’t have to tell people they can’t do things… but we really want to be a full partner with those that do business,” Wyant says.

Working with Lawmakers

Director Wyant was appointed by Republican Governor Snyder but he, also, works closely with the state legislature.  The GOP majorities in both the state House and Senate sometimes disagree with both Wyant and Snyder about certain environmental issues.  One such issue is wetlands protection. Wyant says he and the Governor will continue to push the legislature to keep the wetlands program. “The Snyder Administration and myself have been advocating very strongly to keep the program… We think the resource is really important for water quality, it’s very important for habitat and natural resources." And, he notes, he thinks he and the governor now have a majority of lawmakers believing that the program should be saved.

Looking to 2012

Wyant says the goal for 2012 will be focusing on one of the Governor’s favorite phrases, “Relentless Positive Action.” “We do that”, Wyant says, by, “encouraging more environmental stewardship – not less. We want to see Michigan’s economy recover – we think that’s good for the environment. And, lastly, the governor is very focused on customer service – our customers are the citizens of Michigan.”

The political landscape in the U.S. changed overnight last week. The Democratic takeover will mean a big shift in policy-making efforts in Washington. Mark Brush has more on how environmental issues played out in the election, and what this new Congress might do on the environmental front:

The political landscape in the U.S. changed overnight last week. The Democratic takeover will mean a big shift in policy-making efforts in Washington. Mark Brush has more on how environmental issues played out in the election, and what this new Congress might do on the environmental front:

Environmentalists say some of their biggest enemies were defeated in the midterm election. And top on their list of the worst environmental offenders was California Congressman Richard Pombo.

Environmentalists spent millions of dollars on radio and television ads to defeat Pombo, and they say it was money well spent. They came to really despise Pombo because of his work to weaken the Endangered Species Act.


Tiernan Sittenfeld is the legislative director for the League of Conservation Voters. She says many Republican committee chairs, such as Richard Pombo, simply obstructed environmental legislation. She says now that will change.


“It’s not that even that Congress has even voted to pass particular pro-environment legislation; it’s that the house leadership and the committee chairs haven’t even allowed such legislation to come to the floor. They haven’t even wanted a debate on it. So I think having different leadership, having different committee chairs who care about protecting the environment, who care about clean air, clean water, and open space is going to be a whole world of difference.”


So now that the Republican leadership is out who is taking their place? One legislator who is expected to gain a lot of power is Democrat John Dingell of Michigan. He will chair the House Energy and Commerce Committee.


Dingell says he, and other Democratic committee chairs will first use their power to make sure that existing environmental laws are being enforced by the Bush Administration.


“This administration has been totally unsupervised by the Congress, and checks and balances which are so important to the Founding Fathers, and legislative oversight, have simply not taken place since the Bush Administration came in.”


Dingell will be joined by many other legislators who are likely to have strong environmental agendas. People like Barbara Boxer, Harry Reid, and Henry Waxman. They have several issues in mind that they feel have been mishandled by the Bush Administration. Top on their list is energy policy and global warming.


On energy, environmental lobbyists say high gas prices have made the issue one that resonates with voters.


Karen Wayland is the legislative director for the Natural Resources Defense Council. She says the new Congress will revisit the tax breaks and other financial incentives given to oil companies in the last energy bill.


“I think what something the House will do at least will be to look at the royalty relief that Congress has given to the oil companies and sort of try to roll back some of the royalty relief; make the oil companies pay full price for extracting oil from our public lands and then use that money to invest in clean energy.”


Democrats are also expected to make a push for national renewable energy standards, and higher fuel economy standards for cars and trucks.


As for global warming, the Democrats say the Bush White House and the Republicans in Congress have completely ignored the issue. The Democrats are expected to introduce several global warming bills in the next session.


But while the Democrats gained a lot of power, they still will have to work around the threat of a presidential veto. And in the Senate, the republicans still hold more than enough seats to block legislation.


Darren Samuelsohn is a senior reporter with Greenwire, a Washington DC based news service covering energy and environmental policy. Samuelsohn says while the Republicans still hold a lot of power, it’s interesting to see how much of it was eroded overnight.


“As you start to talk about it and think about it, it’s across the board: it’s judges, it’s legislation, it’s oversight. And then the thing that really nobody outside of Washington ever really kind of knows what’s going on about, but the whole huge appropriation – the whole federal budget process. That will now be Democrat controlled and we’re talking about hundreds of billions of dollars that get spent every year.”


Samuelsohn says the Democrats will now face the challenge of finding more money for their favorite environmental programs, while at the same time making good on campaign promises to cut the huge federal budget deficit.

The Sierra Club has been at odds with President Bush’s approach to the environment from the
start. Now, during this election year, the Sierra Club’s Executive Director is touring the country,
taking the concerns to anyone who’ll listen. Carl Pope recently visited the Great Lakes region.
There, he complained about the Bush administration’s loosening of mercury restrictions, its
exemption of factory feedlots from the Clean Water Act and a proposal to allow cities to blend
raw sewage with rainwater during big storms and release it into streams and lakes.


“It doesn’t make any sense to allow people to contaminate the waters and then spend a lot of
money a decade later, cleaning it up. It’s much cheaper to keep contamination out of the Great
Lakes.”


The Bush administration says rather than cleaning pollution at any cost, its environmental policies
consider the financial cost versus the benefit to the environment.

address the issue and to find ways to adhere to what’s called “Smart Growth.” The Great Lakes
Radio Consortium’s Lester Graham reports that there’s a lot of interpretation of what “Smart
Growth” means:


Many urban planners have been alarmed over the last couple of decades as metropolitan areas have
sprung up where farmland or wooded areas once stood. Following new subdivisions have been
strip malls, parking lots and fast food franchises in a not always attractive fashion.


Last year’s election saw a number of states with new governors and some of them are looking at
what can be done to control that kind of unbridled growth. Michigan’s Jennifer Granholm noted it
during her State of the State speech.


“We will develop a cooperative, common sense approach to how we use our land so we can protect
our forests and farms, prevent the sprawl that chokes our suburban communities and threatens our
water quality, and bring new life to our cities and older suburbs.”


Governor Granholm says she wants “Smart Growth.” It’s a popular term, but what is it? What
does it mean?


“I think that Smart Growth is really hard to – certainly hard to describe.”


Barry Rabe is a Professor of Environmental Policy at the University of Michigan’s School of
Natural Resources and Environment. He says “Smarth Growth” sounds great.


“I don’t know anyone who’s really against Smart Growth. But, you can spend a long academic
seminar or actually a lifetime in search of the one common definition of exactly what that means.
Again, it has sort of an intuitive appeal. It resonates. We can all think of examples that are not so
Smart Growth or dumb growth. But, I think clearly this is something that lends itself to differing
kinds of interpretations by different groups.”


And as you ask the people who’ll be sitting at the table debating “Smart Growth,” it becomes clear
that each one has a different definition.


Lynn Egbert is the CEO of the Michigan Association of Home Builders. He says “Smart Growth”
is a private citizen building a home wherever he or she thinks is an ideal site.


“Our basis continues to be and our primary focus is, and it will remain, that it’s private property
rights under the U.S. Constitution that have to be maintained and that is an individual right. It is a
citizen’s right. And we have to work with local and state government to make sure that that’s
achieved and balanced.”


Egbert says the culprit causing urban sprawl is not the choices that landowners make. He says it’s
too much government regulation. Egbert says, generally, municipalities that zone areas into large
lots stop home builders from building more houses on smaller plots of land.


Others also place much of the blame for sprawl on government, but for different reasons. Hans
Voss is with the Michigan Land Use Institute.

“Landowners do have a right to live in the area in which they choose as long as they follow local
land-use regulations and pay the full cost of that lifestyle. And right now the taxpayers in the cities
and across the whole states are actually subsidizing that style of development.”


Voss says to implement “Smart Growth,” the government has to stop subsidizing urban sprawl by
building highways and sewer systems that all of us have to pay for with our taxes instead of just the
residents who benefit from them. He says that money could be better used to revitalize older
suburbs and the center of deteriorating cities.


There are a lot more ideas of what “Smart Growth” means… and there’s a bit of public relations
spinning because of the ambiguity of the term “Smart Growth.”


The University of Michigan’s Barry Rabe says we’ll hear a lot about “Smart Growth” for some
time to come.


“It’s one of these buzz words that everybody likes. But, to come up with a common definition of
it, much less figure out how that would be implemented in public policy is tricky.”


Ultimately, compromise will define “Smart Growth” as states grapple with trying to find better ways
to use land without losing so much farmland to sprawling subdivisions and paving over natural areas
for parking lots.

Modified Crops Swap Genes With Weeds

Genetically modified crops are planted throughout the Midwest, but some scientists are concerned genes from these crops could escape and work their way into weedy plants. With these genes, weeds could become more vigorous and harder to kill. New research shows this can happen between closely related crops and weeds. The Great Lakes Radio Consortium’s Cristina Rumbaitis-del Rio prepared this report:

Genetically modified crops are planted throughout the Midwest, but some scientists are
concerned genes from these crops could escape and work their way into weedy plants. With
these genes, weeds could become more vigorous and harder to kill. New research shows this can
happen between closely related crops and weeds. The Great Lakes Radio Consortium’s Cristina
Rumbaitis-del Rio prepared this report:


Genetically modified crops have been around for quite a while. In the U.S. last year more than 88
million acres were planted with genetically modified soybean, corn, cotton and other crops. Some
of these plants are engineered to be more resistant to herbicides, making it easier for farmers to
get rid of weeds without damaging their crop. Others are engineered to resist plant-eating insects.


But some scientists worry about the ecological effects of these crops. Allison Snow is a professor
of ecology at Ohio State University. She studies genetically modified sunflowers. Snow says she
got involved in this research when genetically modified crops were first being introduced because
she was afraid no one else was looking at the environmental effects of these crops.


“It was kind out of a fear factor for me of wanting to make sure that someone was watching to see
what the environmental effects might be.”


The sunflowers Snow studies have a gene added to them, which produces an organic insecticide
that kills insects feeding on the plants.


According to Snow, the problem with these pesticide-producing sunflowers is the insect-killing
gene can be transferred from crop sunflowers to their weedy cousins, which are often growing on
the edges of fields. Bees, flies and other insects can transfer the gene to the weeds by cross-
pollinating the plants, which are close relatives. Snow’s research shows once the gene gets into
the weed population, the weeds become insect-resistant as well.


“The new gene worked really, really well in the weeds. It protected them from the insects. And
because they were protected, they had more energy to devote to making seeds.”


Snow says the most startling result was the number of seeds these weeds were making.


“In one of our study sites, they made 55% percent more seeds per plant – just because of one
gene. Which is kind of unheard of. We’ve never seen a result like that – where one gene would
cause the whole population to suddenly start making 55% more seeds.”


The gene might make weeding a more difficult task, but Snow says she wouldn’t quite call them
“super weeds,” a term some environmentalists have used.


“We might see that the weedy sunflowers become worse weeds, I wouldn’t call them super
weeds, because to me that would imply that they have many different features instead of just one
that causes them to make more seeds. But I could imagine in the future there might be enough
traits out there that could turn a regular weed into something much more difficult to control – like
really would be a super weed.”


Snow says she will have to do more research to see if the extra seeds made by the weeds will turn
into more weeds and hardier weeds in farmer’s fields.


But, she might not be able to finish her research on sunflowers because the companies that make
the crop have decided not to renew her funding and won’t give her access to the sunflowers or the
genes.


“It was all about stewardship and responsibility.”


Doyle Karr is a spokesperson for pioneer hi bred, one of the companies which makes the
sunflowers. He says the company realized a few years ago there wasn’t enough demand for the
product to justify commercially producing it. As a result, he says, the company couldn’t continue
funding sunflower research, and doesn’t want to be held responsible for keeping the gene safe
while the research is being conducted.


It’s an issue of a biotech trait that we are not pursuing and not bringing to the market, and if we’re
not bringing it to the market, we can’t justify taking the responsibility of having that trait out
being worked with, with a third party.”


While some academic researchers argue the universities take on legal liability when they work
with genetically modified plants, Karr says the university’s liability is often limited by state law.
He says the company is ultimately held responsible if only by the court of public opinion.


“Should something happen with this gene that was not expected or a mistake happened – that
would ultimately come back to those who initially made the gene available.”


While this issue remains unresolved, Snow is continuing her research. Genetically modified
sunflowers are not the only crop to study. Snow is now working in Vietnam where weedy species
of rice grow naturally, and where genetically modified rice might be introduced in coming years.
She’s concerned the traits of the genetically altered rice might be transferred to the wild species
of rice, just as happened with the sunflowers.

Congress to Approve Seaway Expansion Study?

Congress is considering spending up to 2-million dollars for a long-term study of widening and deepening the Saint Lawrence Seaway. Opponents say an expansion of the Seaway will only mean more environmental trouble for the Great Lakes. The Great Lakes Radio Consortium’s Mike Simonson reports:

deepening the Saint Lawrence Seaway. Opponents say an expansion of the Seaway will only
mean more environmental trouble for the Great Lakes. The Great Lakes Radio Consortium’s

The bone of contention is a multi-year study that looks at allowing larger ocean-going ships to get
through the Seaway. The Seaway links the Great Lakes to the Atlantic Ocean. The National
Wildlife Federation’s Rick Spencer in Washington says that would rip up the Saint Lawrence
River and stir up pollution from Montreal to Milwaukee.


“Dredging hundreds of millions of cubic yard. Blasting islands. You are destroying fish habitat,
you’re going to be releasing toxic sediments. You’re going to increase the risk of new invasive
species.”


Right now channels are 25 feet deep. The study will look at digging 10 feet deeper, allowing
ships to take on more cargo at less cost. Duluth Port Director Davis Helberg says the protests are
exaggerated.


“We’re talking about a study. We’re talking about an analysis that will focus on engineering,
economics, and on the environmental aspects of keeping the Seaway competitive in the long
term.”


The proposal is in the House and Senate conference committee and will be decided later this
month.

Conventional wisdom finds that Democrats are more often friendly to environmental issues than
Republicans. Of course that’s not always true, but when four Democrats seized four
governorships that had been long-held by Republicans, many environmentalists were optimistic
they’d get a better deal. That optimism might be short-lived. Now that the Democrat governors
in Illinois, Wisconsin, Michigan and Pennsylvania have had time to look at the budget, the reality
of politics is setting in and in most cases the environment isn’t quite as high on the list of
priorities. Each of the states is facing budget shortfalls, some amounting to a couple of billion
dollars. And in three of those states the Democrat governor will have to work with a legislature
controlled by Republicans. Political observers say it’s clear that the new governors will have to
find compromises in any environmental initiatives they talked up during the campaigns.

An EPA study says that less than one percent of lakes in the Upper Midwest suffer from the
effects of acid rain – down from three percent 20 years ago. Air pollution officials disagree on
what to do next about the harmful precipitation. The Great Lakes Radio Consortium’s Chuck

The EPA credits the improvement in the health of lakes to a 1990 law that reduced sulphur
dioxide emissions, mainly from coal-burning power plants. Cutting SO2 pollution means several
things, including less disruption to the Lakes’ food chain. Now the EPA agrees with President
Bush’s call for Congress to pass his so-called Clear Skies Initiative. That plan aims for more
reductions in sulphur dioxide, as well as cuts in emissions of nitrogen oxides and mercury. But
several state air pollution regulators say the plan doesn’t go far enough. Lloyd Eagan is with the
Wisconsin Department of Natural Resources.


“Basically my feeling is that the levels in the Clear Skies Initiative really offer too little reduction
and it comes too late.”


But the EPA calls the Clear Skies Initiative a market-based, workable approach to pollution
control.

But the Great Lakes Radio Consortium’s Lester Graham spoke with journalists around the region who feel politics and state budgets will slow any change the new governors might want:

of the states around the Great Lakes. In most of those states, the governors’ seat went from
Republican to Democrat. Some environmental groups are optimistic that the changes will benefit
their causes. But the Great Lakes Radio Consortium’s Lester Graham spoke with journalists
around the region who feel politics and state budget problems will slow any change the new
governors might want:


Five of the eight Great Lakes states have new governors. Four of those states went from
governorships long-held by Republicans to a Democrat governor.


For example, Republicans held the Illinois govenor’s seat for 26 years. That changed when
Democrat Rod Blagojevich took the office. The environment was not a huge issue in the
campaign. Under the Republicans there’s been an interest in acquiring large pieces of land for
parks and creating green corridors. And Blagojevich is even retaining the previous
administration’s director of the state Environmental Protection Agency. Still, some
environmentalists feel they’ll fare better under a Democrat.


At the Illinois capitol, Bill Wheelhouse is the Statehouse Bureau Chief for Illinois Public Radio.
He says the change probably won’t be that significant…


“Environmental groups will see more friendly territory for some of their pet projects to some
degree. But, Illinois is not a liberal state. It’s not one that is concerned with ground-breaking
legislation on the environment or anything else. Politics is a business in that state and that can
never be forgotten.”


Despite that, the new governor, Blagojevich, has outlined a couple of areas he’d like to change.
One is charging businesses for pollution discharge permits, something that’s been free in the past.
It’s popular among lawmakers because it brings in more money for the state which is facing
budget deficits. Bill Wheelhouse says another issue Blagojevich has proposed is legislation
mandating that Illinois power companies use renewable resources such as wind and solar power.


“What it would do is in just a couple of years require that part of the energy portfolio of a utility
company include five percent renewable energy and that would increase, I believe, up to about
15-percent a decade down the road.”


Again, that kind of legislation wouldn’t cost the state any new money. That’s a plus.
Wheelhouse adds that even with Blagojevich’s fellow Democrats controlling both the House and
the Senate, any environmental proposal that doesn’t pay for itself is not likely to get very far,
because of Illinois’ budget deficit.


It’s the same story in other states. Illinois’ neighbor to the north, Wisconsin, also saw a shift
from several years under Republican governors to a newly installed Democrat. Jim Doyle is now
Governor.


Reporter Chuck Quirmbach covers environmental issues for Wisconsin Public Radio. He says
the race for governor touched on the environment, but there was another more immediate issue to
consider.


“The overwhelming issue, the issue common to a lot of states is the state budget deficit here in
Wisconsin, but the environment was an important difference. It energized a lot of environmental
groups to vote for Doyle or this Green Party candidate who got about two-percent of the vote. So,
it was a significant difference. It may not have been the number one issue in the state, though.”


Quirmbach says while environmentalists are optimistic about a Democrat taking the governor’s
office, Governor Doyle will have to compromise with the Republicans who hold a majority in
both chambers of the Wisconsin legislature… and he’ll have to make compromises because of the
state’s budget…


“The threat to the green agenda will be the economy and whether Doyle decides, ‘Well, putting
people to work might be more important than protecting certain wetlands or protecting the
environment from air pollution.'”


Across Lake Michigan from Wisconsin is another state that’s long had a Republican governor.
Michigan elected Democrat Jennifer Granholm, and in Michigan, the environment was a key issue
in the campaign for governor.


Sarah Hulett covers state government for Michigan Public Radio Network. She says the
Democrat governor quickly moved on an environmental issue which gets some Republican
support in Michigan.


“Right when the governor came in, Governor Granholm, she put together a land-use commission
— Smart Growth Commission, I think, is the name of it — made up of Democrats and Republicans
and involved the Republican leaders in both chambers in that. So, she’s off to a pretty good start
in terms of the environment, I’d say.”


But, like Wisconsin and Illinois, Michigan is facing budget problems and Hulett says the new
Democrat governor might find the environmental initiatives that cost the state will be a hard
sell to the Republican-held legislature.


“Well, the deficit is huge. And, so, that affects everything across the board. And, you know, the
environmental community is having to be patient with some of these initiatives.”


It’s a similar story in Pennsylvania where Democrat Ed Rendell took the governor’s seat from
Republicans. Rendell is friendly to environmental issues, but he, too, has to deal with a budget
deficit and he has to work with a Republican-controlled legislature.


So, despite conventional wisdom which indicates more enviro-friendly laws might come from a
Democrat in the Governor’s mansion, in those states where there’s been a change, the economy
might force those governors to put the environment further down on the list of priorities.

An international group that monitors the health of the Great Lakes is working on a report that
they hope will help policymakers manage the waters in the basin. The Great Lakes Radio
Consortium’s Annie MacDowell reports on a public hearing that took place in Chicago:


Concerned groups responded to a report that came out two weeks ago by the International Water
Uses Review Task Force. The International Joint Commission appointed the task force to
provide an update on developments that have taken place in the basin since the Commission’s
2000 report.


Noah Hall is from the National Wildlife Federation’s Great Lakes Office. He says he’s
concerned the task force’s report does not emphasize how serious threats to the Great Lakes have
become.


“The report could mislead the public or interested policy makers and lull policy makers into
complacency in terms of the need and the urgency for basin-wide protection for the Great Lakes,
particularly for ground water.”


Hall said ground water depletion is causing problems in the communities around the Great Lakes
Basin. Other criticisms of the report were its failure to look toward the future on issues like
climate change and water diversion. The U. S. Chairman of the IJC says the Commission will
study all the public’s comments at a retreat and write their official report within two to three
months.
