State Sues Great Lakes Sewer Plant

Raw sewage from urban areas is a big source of pollution
in the Great Lakes. And a lot of people are fighting over how best to keep it out. Now, the Milwaukee area’s sewer district is once again the focus of a bitter legal fight. The Great Lakes Radio Consortium’s Shawn Allee reports on the dispute:

the focus of a bitter legal fight. The Great Lakes Radio Consortium’s Shawn Allee reports on the
dispute:


Last week, Wisconsin’s Attorney General filed suit against the Milwaukee Metropolitan
Sewerage district. The suit seeks extensive upgrades to keep raw sewage out of Wisconsin’s
waterways.


Last year, spring storms overwhelmed local sewers and the district dumped millions of gallons of
raw sewage into rivers and Lake Michigan. Sewer district spokesperson, Bill Graffin, says the
lawsuit seeks the impossible – a perfect sewer system.


“You can never ever say that you will eliminate all overflows, because you never know what
Mother Nature’s going to throw at you. If you design your system to the biggest storm you’ve
ever had, there’s always the possibility that a bigger storm’s going to come along.”


The district contends it’s already overwhelmed by current upgrade projects, which may cost
nearly a billion dollars. Many of those projects are required by previous lawsuits.


The Attorney General says the district must improve, and it should either raise additional money
itself or seek state assistance.

Regulatory Commission to upgrade security at nuclear power plants
to defend against terrorist attacks. The Great Lakes Radio
Consortium’s Lester Graham reports:


The Nuclear Regulatory Commission has stepped up security at nuclear power
plants since the terrorist attacks on September 11th, 2001, but it’s still
using a defense plan designed 35 years ago based on four men attacking by
land.


A nuclear watchdog group called Committee to Bridge the Gap has filed
a petition with the NRC, asking that the plan be updated to take into
account the methods and numbers terrorists have actually used. Seven
attorneys general signed a letter supporting the security update. Paul
Laraby is with the New York Attorney General’s office.


“I think what the AGs are trying to do is to introduce common sense
approach to an emerging threat that perhaps was discounted thirty-five years ago.”


Even after more than three years since the attacks, the NRC still has not
determined how it should upgrade the its defense plans for nuclear power
plants.

One of the biggest dumpers of raw sewage into the Great Lakes this year may be heading toward a solution that puts the clean-up burden on local citizens. The Great Lakes Radio Consortium’s Chuck Quirmbach reports:


Several cities dumped sewage into the Great Lakes during heavy rains this spring and summer. Milwaukee’s overflow total was about five billion gallons. A task force set up by Milwaukee’s mayor concludes much of the problem came from rainwater leaking into the sewer system through illegal hookups and cracked pipes between homes and sewer mains. Mayor Tom Barrett says reducing the so-called infiltration and inflow, or, I and I, will be expensive.


“Well, we’re obviously going to have to put more dollars into I and I in Milwaukee. The city has done that, we’re doing more in this budget, we’re going to continue to do more… I think each of the communities is going to have to face that issue.”


The “communities” are the roughly 30 smaller cities that use the Milwaukee sewer system. Wisconsin’s attorney general is trying to ge the city and suburbs to work together. Milwaukee and many other Great Lakes cities are also asking the U.S. government to spend more money on reducing sewer overflows.

Attorneys general from eight states have filed a lawsuit against
several major U.S. power companies. They say the utilities need to cut
down on the amount of heat trapping gasses they release. The Great
Lakes Radio Consortium’s Chuck Quirmbach reports:


New York, Iowa and Wisconsin are among the states suing five large
utilities that emit about ten percent of the nation’s total carbon
dioxide pollution. The states say many scientists believe the CO2
emissions contribute to global warming.


Peg Lautenschlager is Wisconsin’s Attorney General. She says a rise in
global temperatures would harm the Great Lakes region.


“We are looking at lowering Great Lake water levels… which will not
just impact the Great Lakes and the fish and wildlife that are therein,
but will also have severe economic impact.”


Lautenschlager says the Midwest would also see changes in crop cycles
and weather patterns. The lawsuit does not seek monetary damages…
but aims to have the utilities cut their carbon dioxide pollution.


Midwest environmental groups praise the legal action. But some
utilties say they already have plans to reduce CO2… and consider the
new lawsuit frivolous.

Governments Grapple With Regional Transport

Many large cities throughout the Midwest have been struggling with issues such as urban sprawl. Getting workers from one area to the jobs in another has become a transportation challenge. Building multi-lane highways only seems to encourage more sprawl, so many cities have worked with surrounding suburbs to build mass transit systems for the entire metropolitan region. For one major city, political leaders are just now getting around to making that happen and as the Great Lakes Radio Consortium’s Jerome Vaughn reports… even now it’s not going to be easy:

Many large cities throughout the Midwest have been struggling with
issues such as urban sprawl. Getting workers from one area to the jobs
in another has become a transportation challenge. Building multi-lane
highways only seems to encourage more sprawl. So many cities have worked
with surrounding suburbs to build mass transit systems for the entire
metropolitan region. For one major city, political leaders are just now
getting around to making that happen. And as the Great Lakes Radio
Consortium’s Jerome Vaughn reports… even now it’s not
going to be easy:


Detroit is the 10th largest city in the country…and it’s had more than
its share of struggles over issues such as chronic unemployment, poverty,
and pollution.


Finding solutions to those intractable problems has long been a goal of
government leaders in the area. But over the past three decades…they’ve lacked
one tool… used by most other metropolitan areas
around the country…that can make a difference. A regional transportation
system.


But that’s about to change.


Michigan Governor Jennifer Granholm has joined Detroit Mayor Kwame
Kilpatrick…and the heads of the three largest counties in Metro
Detroit…to announce the formation of the Detroit Area Regional
Transportation Authority…otherwise known as DARTA.


The new regional transportation authority is backed by local governments,
business interests ..and mass transit proponents. The government leaders have
signed an agreement to work towards the regional transportation
system. Detroit Mayor Kwame Kilpatrick says the new deal will benefit the
city AND suburbs.


“This is a real people thing today. It’s also an economic thing…and it’s
rare when these two things come together. This will drive the economic
engine of the state. To move people to jobs…leads to economic
independence.”


The agreement is the first step towards ending decades of debate over how
best to get workers from their homes to their jobs. With many Detroiters
living below the poverty level…owning a car is impossible. But that can
mean taking several buses over a span of three hours just to get to work
each day.


That type of commute is what DARTA proponents, like such as Attorney Richard
Bernstein hope to end. As a blind man…he’s unable to drive to get
where he needs to go. He says Detroit’s lack of coordinated mass
transportation pushed him to become a transit activist a couple of years
ago.


“As a disabled person who can’t drive…I struggle for my independence and I
struggle for my freedom. And DARTA is the only hope that someone like me
has in order to lead a quality of life here in Southeast Michigan.”


Bernstein says he’d like to have that extra measure of independence. But he
says…right now…it’s impossible for him to get around town on his
own…given the current state of mass transit in Metro Detroit.


“For me right now …it isn’t that regional transit is difficult to
use…it’s that it’s non existent …that is the issue. Ultimately, if I want
to get from my house …or my apartment to my office. There is no bus I can
take. There is no bus I can take from my office to court.”


But Bernstein’s passion for regional transportation isn’t uniformly shared.
The original measure creating DARTA was vetoed by former Governor John
Engler last year as one of his final acts in office. The state legislature
tried to resurrect the bill in January…but it has subsequently
stalled…pushing the new governor, Jennifer Granholm and Detroit Mayor Kwame
Kilpatrick and others to find alternate ways routes to create a working agreement.


The opponents say the regional transportation system is not fair. State
Representative Leon Drolet opposes DARTA because he says his more rural
constituents shouldn’t be taxed for a bus system they’ll never use. He wants a
provision that would let communities “opt-out” of the DARTA if they choose. The
Republican legislator says he also concerned because there’s no plan to pay for
DARTA yet. And he says no one’s convinced him that such a system is really
needed in Metro Detroit…home of the Big Three automakers..


“Macomb, Oakland suburban Wayne communities…those are built around the
car. Everywhere there’s a parking lot. Boston, Washington DC, New
York…those communities…mass transit is very viable in the inner areas
because it costs 30 bucks a day or 50 bucks a day to park your car. And
that’s what drives people to mass transit…the inconvenience of driving
your car.”


But automakers say they want the regional mass transit system. The
Southeastern Michigan Council of Government’s Transportation
Expert…Carmine Palombo…says many of the region’s businesses are having a
hard time getting workers from their homes to their jobs. And that includes
the Big Three automakers…who have come out in favor of DARTA.


“The auto company themselves employ people who need to have good transit in
order to get to their jobs…and so they’re feeling the pinch…just like
every other employer is who wants to get…make sure they get to the jobs
they have to offer in a stable environment. So the car companies aren’t the
problem.”

While the Detroit Area Regional Transportation Authority agreement has been
signed….the work is just beginning for transit activists in
Metro-Detroit. The current agreement only provides for planning a
regional transportation system. There’s currently no money for
implementation of ANY plan.


And DARTA opponents such as Leon Drolet are still on the job, too. He’s
charging that the chairman of his county…had no authority to sign
the DARTA agreement…and is asking the State’s Attorney
General to investigate.

Attorney General Takes on Canadian Pollution

The Attorney General in New York has recently led the fight against any softening of laws on air pollution. He’s even taken on the administration in Washington. Now he’s setting his sights across the border where pollution from Canada is affecting his state. The Great Lakes Radio Consortium’s Dan Karpenchuk reports:

New York’s Attorney General Eliot Spitzer has taken on the White House and big air polluters in
the U.S. Now he’s filing a complaint with the Environmental Commission set up under NAFTA.
He wants the commission to look into whether coal fired generating plants in Ontario violate any
Canadian laws.


That move is not sitting well with authorities across the border. Canada’s environment minister,
David Anderson, says he welcomes the challenge, but says Spitzer should be cleaning up his own
backyard first.


“His plants in New York aren’t little innocent neighborhood Dairy Queens. These are major
emitters of pollution.”


Ontario’s environment minister, Chris Stockwell, admits that Ontario doesn’t have a perfect
record, but he, too, says Spitzer shouldn’t be doing any finger pointing.


“The Americans have states where 90% of their energy is coal. Now who’s embarrassed,
Americans or Canadians?”


Ontario has pledged to shut down its coal-fired generators by 2015.


But that isn’t soon enough for Spitzer. If he proves his case, the environmental commission could
impose penalties against the province.

Is Groundwater Fair Game?

In Michigan, the Perrier Group of America is building a water bottling plant near the town of Big Rapids. It’s a project that has raised the ire of local environmental groups, and it’s raised the question of whether groundwater in Great Lakes states should be for sale. The Great Lakes Radio Consortium’s Matt Shafer Powell has the story:

Despite assurances from Perrier, she worries that a plant that pumps more than 700-thousand gallons of water a day will steal water from the area’s lakes and wetlands…

“We are not just talking about the water for the people. We’re also talking about the water for the fish, the mosquitoes, the deer, all of the environment”


But the issue has grown beyond the local impact. Within a few weeks, officials from the Michigan Attorney General’s office hope to release a report on the topic. The question is whether federal law allows Great Lakes governors to prohibit the sale of groundwater-the way they can with Great Lakes water.
