Army Corps and Enviros Spar Over River Levels

Court battles over the Missouri River have subsided… for now. The debate has focused on whether the Corps of Engineers should drop water levels to protect endangered species… or keep a normal flow to ensure barges would be able to ship cargo. In the end… levels went down… but not for nearly as long as courts had ordered. And as the Great Lakes Radio Consortium’s Tom Weber reports… this summer’s fight might just be the first battle in a war over the river’s management:

Court battles over the Missouri River have subsided… for now. The debate has focused on
whether the Corps of Engineers should drop water levels to protect endangered species… or keep
a normal flow to ensure barges would be able to ship cargo. In the end, levels went down, but not
for nearly as long as courts had ordered. And as the Great Lakes Radio Consortium’s Tom Weber
reports, this summer’s fight might just be the first battle in a war over the river’s management:


On paper, the Corps of Engineers lowered the Missouri River this summer because of three
things: The piping plover and the least turn, two birds hat nest on sandbars, and the pallid
sturgeon, a fish that lays eggs in the shallow water.


Lawsuits by environmental groups like Chad Smith’s argued having too much water flowing in
the summertime disrupts and essentially washes away those nesting areas.


But Smith, who’s with the group, American Rivers, says the issue is much larger than two birds
and a fish…


“What we’re trying to do is to restore some semblance of the river’s natural flow, along with a lot
of habitat and try to make the Missouri River look and act more like a river. Right now it’s
managed like a ditch and it looks like a ditch.”


Smith says years of management by the Corps of Engineers – building dams and levees and
controlling river flows – have made river depths fairly consistent. But he says, really, that’s just
not how rivers work.


“You would have snow melt and rain coming into the river in the springtime, increasing the
flows, and then throughout the rest of the year, particularly during the hot summer months, the
levels would be very much lower, and that’s the kind of natural dynamic that fish and wildlife
adapted to.”


And so when a federal judge in Minnesota told the Corps of Engineers to lower water levels on
the Missouri, it was an attempt to get the river back to its natural ebb and flow. The court order
was for a four-week drop in levels, but the Corps only lowered the water for three days towards
the end of the endangered species’ nesting periods.


But even those three days upset business interests along the river, particularly the barge industry.
Towboats can be seen pushing barges up and down the Missouri River between Sioux City Iowa
and St. Louis. A group of politicians and business leaders, in fact, recently met at the Gateway
Arch in St. Louis to criticize the judge’s order. It’s actually the Mississippi River that passes in
front of the Arch, but because the Missouri spills into the Mississippi just north of St. Louis, the
group noted that lowering one would lower the other. And Missouri Senator Jim
Talent says that has a negative effect on jobs and the local economy.


“When that river goes down the barges can’t move. We’re inhibiting barge traffic already and if
this continues it’s going to stop. And we really need to step back from the brink of an action that’s
really just unreasonable and being forced on us by an extreme interpretation of the law by the
courts.”


Congresswoman JoAnn Emerson, whose district borders the Mississippi, wonders why the
Endangered Species Act that essentially won the lawsuit to lower levels is of higher importance
than people’s livelihoods.


“My mandate in Congress is from the people up and down the Mississippi River, people from my
Congressional district. My mandate isn’t from the piping plover or the least tern or the pallid
sturgeon.”


The debate over the Missouri River might have been moot if not for one other factor: A drought
has plagued parts of the Midwest for more than a year and made the rivers even lower.


A few days after the group met at the Arch, the Mississippi River got too shallow for any barge
traffic and closed for a weekend. Having cargo just sitting there, not getting to market, cost the
economy a million dollars a day by some estimates.


Barge groups blamed the lowering of the Missouri; environmental groups blamed the drought.
Barge traffic is moving again and the nesting season is over for the endangered species named in
the lawsuit. But the fight is far from over as both sides appear ready for another round. Once
again, Chad Smith with American Rivers.


“We’re prepared to stay in court for as long as it takes if the Corps is going to continue to be
obstinate about this. The Corps is now on notice through the court actions this summer that these
things are serious and they can’t hide from them.”


For its part, the Corps has said it will work with other government agencies, namely the U.S. Fish
and Wildlife Service, to come up with a plan for managing the river for both wildlife and the
barges in time for next year. But it has said that before, and the two sides seem just as
far apart as they’ve ever been.

Some environmentalists and local public health authorities say the plan is too little, too late. About twenty golfers are using this indoor golf driving range to get their game in shape just
weeks before they’ll be able to enjoy playing outdoors.


But along with the nicer golf weather will come this year’s first assault by mosquito populations,
some of which are sure to carry the West Nile virus.


Like the general public most of these golfers have a mixed reaction to the dangers posed by West
Nile.

It was only two years ago that the West Nile Virus had been found in a few dead crows in North
America. Now it’s spread across much of the continent and it’s blamed directly for killing dozens
of people and infecting hundreds of others.


Last fall, Ontario’s medical officer of health, Colin D’Cunha, gave this statement when questioned
about the spread of West Nile.


“I don’t view this as cause for alarm. And I have to remind people that the serious signs and
symptoms are seen in less than one percent of people who come down with West Nile virus
infection. And to put it in context remember that the flu kills about nineteen hundred Canadians
each year.”


Victims says it was that kind of comment from a health official that caused them not to be overly
worried.


Vern Thomson became infected with the virus during his daughter’s wedding rehearsal in the
backyard of his Mississaugua home, just west of Toronto.


His wife Huguette says within days he was paralyzed and almost died. She says there wasn’t
enough warning about what West Nile could do.


“We knew there were a couple of crows that had died and I mean we knew that West Nile virus
was coming. But unfortunately we trusted our elected officials to inform us how near it was. I
mean, just because a couple of crows had died. Of course we didn’t pay that much attention to it.”


Her husband still has not fully recovered from the virus.


Tropical disease experts also raised alarms about the dangers of West Nile. Some say the Ontario
government played down the threat last year and kept crucial information out of the public
domain.


According to official Ontario government data, there were 374 West Nile cases in the province
last year. But some experts say that number was at least one thousand.


Recently Ontario announced a seven-point plan to fight the spread of West Nile virus. It includes
more surveillance, a public education campaign, mosquito controls, and more money for research.


But when the province’s health minister, Tony Clement, and the chief medical officer, Colin
D’Cunha, attended the news conference to unveil the plan, they ran into an angry Huguette
Thompson.


“I want to tell you I was in the hospital sitting next to my husband that was dying of West Nile
virus and I was so appalled by your comments doctor.”


“Well Ma’am, I want to assure you that Dr. D’Cunha…”


“I am telling you exactly that people did not take this seriously because of your comments.”


“Ma’am I want to assure you that whenever we were approached, our actions and our commentary
were to take this seriously, there is no question.”


“You’re too late with your plan.”


But health minister Tony Clement insists there was no attempt to downplay the seriousness of the
virus.


“We made it clear that everyone who does not protect themselves is taking a risk, and it is our
intention this year, as we look ahead, now that we have more information, now that we have the
experience of last year, to move ahead with our seven-point plan, and to make sure that Ontarians
are as protected as anyone else in North America.”


But complaints also came from local medical officers, who say they’re disappointed with the
amount of money the province has put into the plan.


Environmentalists are also disappointed.


Katrina Miller is with the Toronto Environmental Alliance.


“I think that the response to this point has been this kind of immediate, hurry-up crisis
management response instead of a long term plan to deal with a disease that we know is here to
stay. We need permanent measures of control, not toxic measures of control that we have to keep
applying. If we used a larvacide, if we use adulticides, we have to keep putting them out there,
and we don’t know how effective they’re going to be.”


Tropical disease experts are now warning people to brace for this year’s onslaught of West Nile
virus. They say it will come earlier and hit harder this spring.


They say birds dying of the virus in April or early May will greatly increase the risk of it
spreading across the continent, infecting tens of thousands of people.

Record high lake levels in the mid-1980’s caused extensive erosion, and below normal levels the past three years have forced ships to carry less cargo, to avoid running aground. The International Joint Commission’s Frank Bevaqua says this begs the question: Is the flow of water out of Lake Superior being handled correctly?

“There’s also the communities along the shoreline that may be susceptible to flooding and erosion and the recreational use of the lakes, particularly by boaters. And then there’s the environmental impact, which is probably the area in which we have the least precision in terms of what we know.”

The IJC is asking Washington and Ottawa to pay for a three-year study of the effect water flowing out of Lake Superior has on the other Great Lakes.

Since September 11th, the U.S. government has been closing security gaps in aviation. But maritime officials warn that security on our Great Lakes is even less certain. Recently the U.S. Coast Guard held an international conference in Cleveland on Great Lakes security. The Great Lakes Radio Consortium’s Karen Schaefer reports:

On September 11, about 55 commercial U.S. and foreign freighters were cruising the Great Lakes and the St. Lawrence Seaway. Even as the nation’s airports were being closed, U.S. Coast Guard officials were ordered to stop and search those vessels. It took two days for the search to be completed. Commander James Hull heads the Coast Guard’s 9th District, which oversees shipping in the Great Lakes region. He says that action alerted the Guard to a serious problem.

“Didn’t know exactly where all those ships were. AIS system solves that.”

AIS is a new communications protocol now being developed by the International Maritime Organization. Using a global positioning system, ships equipped with AIS will be able to transmit their exact location – and identity – to other vessels and maritime authorities. But so far, the system hasn’t been widely adopted. And that’s just the first security risk the Coast Guard discovered.

“We had people asking how you drive the ships and how you get training?”

As the weeks went by, the list of vulnerable areas grew. Nuclear power plants located along the lakeshore, ports and harbors, bridges, tunnels, and locks. Ships carrying hazardous cargo and those from countries with known terrorist links. And then there are the thousands of cargo containers shipped daily from ports around the world.

27-hundred reservists were called up to assist the Coast Guard in patrolling and monitoring sensitive areas. The federal government allocated more than 220-million dollars in additional funds. But four months after the terrorist attacks, more than 50-percent of the Coast Guard’s efforts are still being spent on security. The Guard’s original mission – to guide maritime operations, assist in search and rescue, and help clean up environmental problems – has been largely overshadowed. Nonetheless oversight of commercial shipping is part of the Coast Guard’s job. Goods shipped on the Great Lakes are worth more than 742-billion dollars a year to the U.S. economy. Most of those goods and raw materials enter or leave the Great Lakes in bulk shipments and in containers that are off-loaded directly from ships. Dr. Steven Flynn is a former Coast Guard Commander and a Senior Fellow with the National Security Studies Program at the Council on Foreign Relations in New York City. He says a disruption to Great Lakes shipping could have wide-reaching consequences for the entire U.S.

“And so if we have another incident…we’re still extremely vulnerable, we’re still not out of the woods on this here – that if it happens in those sectors, my fear is not just the consequence of seeing another sight like I saw on September 16 after the attack, but also is the disruption that would come from happening within those sectors.”

Those disruptions could also severely hamper the Canadian economy, which ships much of its grain and steel through the Great Lakes. As the U.S.’s largest trading partner and nearest neighbor, Canada already shares jurisdiction over Great Lakes resources through the International Joint Commission. Now government officials on both sides of the border say it’s more important than ever to work together.

John Adams is the Canadian Coast Guard Commissioner. He says the U.S. and Canada have recently signed a 30-point plan to jointly improve security on the Great Lakes, while allowing trade to flourish. Both governments have already instituted new 96-hour arrival notification requirements for vessels coming into North American ports. And they’ve extended the international maritime borders from 3-miles to twelve. But there are plenty of other new security plans yet to be adopted, ranging from identity cards and background checks to a point-of-origin system for clearing container cargo. And both countries will be sending representatives to the International Maritime Organization conference in London, where organizers hope to move ahead with new standardized strategies to keep global trade secure.
