reports environmental and conservation groups are going to court to defend
one of the toughest ballast water laws in the country:

The fight over foreign invasive pests in cargo ships is heating up. Mark Brush
reports environmental and conservation groups are going to court to defend
one of the toughest ballast water laws in the country:


It’s been estimated that invasive species in the Great Lakes do billions of dollars in
damage every year. To stop foreign pests from getting into its waters, the state of
Michigan passed a law that affects all ocean-going ships stopping in
its ports. It requires them to sanitize their ballast to eliminate
invasive species that stow away in it.


International shipping agencies sued the state. They say Michigan’s
law will hurt interstate commerce.


Andy Buchsbaum is the director of the National Wildlife Federation’s
Great Lakes office. It’s one of the groups defending the ballast water
law. He says the international shipping industry might have opened
itself up to counter litigation:


“They fired the first shot – the ocean going shipping industry fired
the first shot, but it’s only the first shot. And I think you’re going
to see an awful lot of action that follows through on this. They’re
going to regret that they filed this lawsuit.”


A hearing on Michigan’s Ballast Water law is scheduled to take place
this May.

If you think your neighbor across the border sends too much garbage to
your local landfill, you now have a songwriter on your side. The Great
Lakes Radio Consortium’s Chuck Quirmbach reports:


Some states are dumping grounds for trash from other states and from
Canada. The U.S. federal courts have ruled that the garbage hauling is
interstate commerce and have protected the practice, but that doesn’t
quiet a Wisconsin musician who lives near a fast growing landfill which
takes in trash from three states.


“Thank you for your generosity. Mountains full of garbage give us one
more place to ski.”


Kevin McMullin’s song urges the other states to just send cash instead of
trash, but many pro-business legislators in some states see trash as cash.
So, when environmentalists call for higher landfill dumping fees to try to
slow the amount of garbage… the lawmaker’s song remains the same –
they vote no.

The Great Lakes Radio Consortium’s Chuck Quirmbach reports:


Some states are upset with the pace of federal efforts to address climate change. So, they’re
considering teaming up on their own. For example, New York and some other eastern states plan
to begin a trading program in 2009, aimed at reducing carbon dioxide emissions that contribute to
global warming.


Robert Percival is an environmental law professor at the University of Maryland. He says the
regional efforts must proceed carefully.


“If the federal government fails to take action against a major problem there’s no problem letting
the states step in as long as they do so in a non-discriminatory way.”


In other words, the states can’t interfere with interstate commerce, by ruling against utilities or
other firms that produce products outside their regional collaboration. If the states do
discriminate, they’d need to get approval from Congress, and with Capitol Hill and the White
House currently on the same page on many issues, it isn’t clear federal lawmakers would back the
states.

pace of trash being shipped to its landfills. We have more from the Great Lakes Radio

A new report says one-quarter of the trash going to Michigan’s landfills comes from out-of-state.
Some of it is from neighboring Midwest states such as Illinois and Indiana, some it from as far
away as the east coast. Most of Michigan’s out-of-state waste comes from Canada.


Landfill space is abundant in Michigan and dumping costs are low. But there’s a movement afoot
to try and slow the pace of trash headed to Michigan landfills.

“We have sited so many landfills over the past decade or so that we have literally become the
dumping ground of North America.”


Legislation is pending to limit the types of waste that can be dumped in the state’s landfills, and
to make dumping more expensive.


Those efforts have been dealt a setback. A court has ruled transporting trash is a form of
interstate commerce that can only be regulated by the U.S. government.
