country might think it’s just a local
issue, but there was a time when this
very same pollution problem made national
news. In the first part of a series
on Dow and dioxin, Shawn Allee met the man who took the issue to Congress
and who feels it should make news again:

In 1981, President Ronald Reagan appointed Valdus Adamkus to a regional Environmental Protection Agency office. From the get-go, one of Adamkus’ jobs was to study dioxin pollution that got into the Great Lakes. His office compiled this report that said dioxin is a cancer risk, and that a Dow Chemical plant in Michigan was responsible for some dioxin pollution.

Adamkus says his bosses in Washington called this report “trash.”

Adamkus: “We simply refused to retreat from our findings.”

Allee: “Did they ask you to retreat from your findings?”

Adamkus: “Yes, unfortunately we almost got instructions, let’s use a very mild word, to change our report. And that brought us Congressional hearings, which probably the entire country was watching on TV networks.”

Koeppel (ABC Archive ): “An official at the EPA today said the Dow chemical company was allowed to participate in the redrafting of a report on dioxin contamination that had been critical of Dow. And that official charged that Dow’s involvement was at the direction of the EPA’s acting chief.”

That was March 18, 1983, and ABC’s Ted Koeppel wasn’t the only one covering the Congressional hearings.

All the TV outlets caught this line from Adamkus –

Adamkus ( ABC Archive ): “It’s unethical, unusual, unprofessional to get the internal document approved by outside company.”

So, higher-ups in the EPA allowed Dow to edit the report critical of the company. But, in some ways, Adamkus won. His boss got ousted and Ronald Reagan gave Adamkus a civil service award for integrity.

As for Dow Chemical’s involvement?

For a month, I asked for comment.

A Dow spokeswoman said the company was interested in talking about the future, not the past.

Adamkus eventually left the EPA and he became President of Lithuania. But back in the US, there was a surprising follow-up to his fight over dioxin.

Mary Gade was a young staff attorney back when Adamkus was on TV. Twenty-three years later, President George W. Bush appointed her to Adamkus’ old job. When Gade arrived – dioxin was still a problem in Michigan.

“My staff in the region characterized this as probably the worst dioxin contamination in the country.”

And, she saw it as a national issue.

“You’d like to expect that your government will function appropriately, that corporations will act responsibly and that you can be assured of a safe and healthy environment for you and your family.”

So, Gade ordered Dow Chemical to clean up some hot spots.

“They would either do the work themselves or the federal government would go forward and do it on their own, and then go back and sue Dow to cover our costs.”

Michigan politicians complained about Gade, and some state officials felt some of her actions were counterproductive. In May 2008, she was forced to resign.

Gade told the Chicago Tribune, it was for being tough on Dow.

The EPA hasn’t commented on that, and Dow denies any involvement.

Recently, Mary Gade’s old boss, Valdus Adamkus, returned to his old EPA office to say hello. He asked about the dioxin problem in Michigan, and he learned it’s still around – after all these years, and after all the trouble he and Mary Gade got from it.

“When I hear from them what enforcement actions are being still considered, and that they are not big progress in that respect, that’s what really bothers me and to me this is inexcusable.”

Dow and the EPA are negotiating a final resolution on cleanup right now.

But Valdus Adamkus knows details need to be worked out, and he says all of this has been promised before.

“God help them. I hope this is really coming to the end.”

Bob Denges is worried. His water is discolored. So he’s
called a water purification company to test it.

They’re running water in the basement utility sink. It’s kind
of orange-y looking. So, it’s an easy diagnosis: too much
iron.

“You can probably see in the toilet, upstairs just on the first
floor, that there’s some brownish, reddish discoloration
around the toilets.”

That’s not great. But at least you can tell when there’s iron
in the water. You cannot see or taste other water
contaminants such as weed killers like atrazine.

Tom Bruusema is the water filter expert at the National
Sanitation Foundation. They test and certify water filtration
devices. He says the first place you can check is your local
municipality – the folks that monitor water in your area.

“That would be the place to start. They are required, by
federal law, to measure a number of contaminants, produce
an annual report for their consumers.”

But recently an investigative report by the New York Times
revealed water contamination can spike in some places –
and local water officials might not even know about it.

That weed killer – atrazine – is applied on farm fields and, in a
lot of places, you also find a lot of atrazine in the water
during that time.

If you’re looking for it at the right time.

Sometimes it spikes for longer than a month. But some local
water officials only test for atrazine once a month, or only
once a year, and often it’s not during that peak application
season.

So people can’t really find out about atrazine levels for their
drinking water in those places.

Some water systems are spending lots of money to treat
drinking water to get atrazine levels down to what the federal
government considers safe levels.

But that might not be enough, according to some of the new
scientific evidence about atrazine.

Five studies published in peer-reviewed journals recently
have found evidence suggesting that small amounts of
atrazine in drinking water causes health problems. Even at
levels considered safe by federal standards, atrazine might
be associated with birth defects. Things like low birth
weights in newborns. Skull and facial malformations and
misshapen limbs.

Forty-three water systems in six states — Illinois, Indiana,
Iowa, Kansas, Mississippi and Ohio — recently sued
atrazine’s manufacturers. They want to force the company
Syngenta and its partner Growmark to pay for removing the
chemical from drinking water.

Steve Tillery is an attorney in the lawsuit.

“Some of them have gone to the expense to cleaning it
completely out of their water supplies, so that it doesn’t exist
at all. And they should, in our view, be entitled to
reimbursement of expenses for cleaning it completely out of
their water supplies.”

But, some water systems are not cleaning out atrazine
completely. And, as we mentioned, there are times when
some don’t know they exceed the federal safe drinking water
levels.

There is something pretty easy you can do if you’re worried
about your water.

Tom Bruusema of the National Sanitation Foundation says a
simple carbon filter can remove atrazine. Those are the
filters you can attach to the faucet or the pitchers you refill.

“So it’s a good investment. Certainly can help them if they
have those kinds of concerns, and particularly those living in
an area that’s known to have potential contaminants in the
water supply.”

But first people have to be aware of a possible problem.
And, too often, they are not.

It’s our first vegetable garden and my daughter and I are looking for some ripe veggies to have for dinner.

It was the highlight of our summer – planting the cucumbers and the eggplant and watching the tomato vines grow higher and higher until we couldn’t even reach the top.

Then I read a story that they had discovered lead in the White House vegetable garden. Exposure to too much lead can cause brain damage, especially in children. And as I read the description of the type of yard that would likely contain lead, I realized that our garden met all of the criteria.

We live in a house more than 50 years old. It’s in an older neighborhood that would have been exposed to residue from leaded gasoline. And we live in a fairly large city -Ottawa, Canada – near a busy road.

So I decided to get our soil tested for lead.

I started by calling the city and other government agencies– no luck. I tried looking for labs in the yellow pages. Those didn’t work out. I moved on to garden centers, a local university, and a local research farm. No one could talk to me.

Finally, I got in touch with a lead expert in Indianapolis, Indiana. He asked me to send him some samples in plastic lunch bags.

“Okay, I just scraped off a place with no wood chips. Okay, so we tested the eggplant, the tomatoes, the lettuce and the cucumbers. Well, we need to do the peppers too, because the peppers are way over here.”

I sent the bags to Gabriel Fillipelli at Indiana University-Purdue University – and waited impatiently. Ripe tomatoes and cucumbers were piling up.

Finally, he got back to us.

“What I found with the samples you took from your soil was relatively high lead values. I was a little bit surprised. Some of them were actually above the EPA levels for playground soils, which is 400 parts per million.”

Great. I figure there’s no chance we could eat these vegetables. But Fillipelli says that’s not the case.

“The other vegetables, like the cucumbers, the eggplants, and peppers – they have very resistant outer skin so as long as you wash them well, very little lead can absorb inside those. The biggest risk you find with vegetables is not lead being sucked up by the roots and poisoning you, it’s actually the soil particles that cling on to the some of these vegetables, meaning beets or carrots or potatoes or, strangely enough, lettuce.”

In terms of children, Fillipelli says the real problem is letting them play in the bare dirt. He actually says covering it with grass or mulch would be safer.

But that doesn’t mean you can’t grow vegetables in a city. You can use containers, or build raised beds with clean soil, and use mulch in between.

It’s still a cheap source of healthy food, and a great way to teach kids about nature, biology and, unfortunately, pollution.

A new report from the Environmental Integrity Project and Earthjustice uses data from the US Environmental Protection Agency – including a study that had been kept quiet since 2002.

Among the findings, people who live near coal ash storage ponds that are unlined, and who get their drinking water from a well, have a 1 in 50 chance of getting cancer from arsenic contamination.

Lisa Evans is an attorney with Earthjustice.

“It by far presents the largest risk to human health and the environment and there’s no reason to manage the waste in this way.”

The groups are calling for these storage ponds to be phased out and cleaned up in the next 5 years.

The EPA says new regulations are coming soon.

Power companies are willing to stop using storage ponds – but don’t want the coal ash classified as toxic. That would make disposal more expensive.

The way your tap water is disinfected might be changing. Federal regulations to improve water safety are leading water utilities to switch the kind of chemicals they use. But Katherine Fink reports one of those chemicals might do more harm than good:

Elmer’s Aquarium has tanks and tanks of fish.

“These are all freshwater; these fish come from all over the world.”

Karen Lukacsena is the Vice President of Elmer’s Aquarium here in a suburb of Pittsburgh.

“Elmer’s has been here for 40 years, and Elmer was my father.”

A lot has changed since Elmer started the business. For instance, there are different products that purify tap water for aquariums:

“Because we don’t really know when someone comes in here what their water’s treated with–whether it’s chlorine or chloramine. And they can always call and check, but to be safe, we just think everyone should go ahead and treat their water.”

Chlorine poisons fish. But if you set water out for a few days, the chlorine will dissipate. Chloramine is different. It’s what you get when you mix chlorine and ammonia. And it does not dissipate. It sticks around.

That’s one reason drinking water providers like it. Paul Zielinski is with Pennsylvania-American Water:

“We don’t see the decay through the distribution system reaching our furthest customers like we do with chlorine; it tends to stay longer in the system and provide a higher disinfectant level, if you will.”

That means even if the water stays in the underground pipes for a long time, chloramine will still be doing the job, disinfecting the water. Until recently, only about one-fifth of water providers used chloramine. Soon, two-thirds of them might be using it. That’s because of new federal rules that take effect in 2012. The Environmental Protection Agency found when organic matter—such as vegetation—mixes with chlorine, it increases the risk of bladder cancer and reproductive problems. So Zielinski says water providers like his are being ordered to limit that risk:

“So one of the ways to do it is obviously to switch from chlorine, which generates these byproducts, to chloramines, which doesn’t.”

But all disinfectants have their downside. For one thing, chloramine corrodes lead and copper pipes. Many water providers add other chemicals to prevent that from happening. But a few years ago, when Washington D.C. switched to chloramine, lead got into the water. Lead is toxic. It can cause learning disabilities. So much lead got into the tap water that researchers believe some young children lost IQ points.

The EPA’s regulatory arm says chloramine’s safe. But an EPA chemist, Susan Richardson, says she’s not so sure:

“Personally, as a private citizen, I would be a little bit concerned myself, and might have a filter on my faucet.”

Richardson’s research found that chloramine also creates byproducts in drinking water. And those byproducts appear even more toxic than the ones created by chlorine:

“I’m really hoping that some of the toxicologists at EPA carry this further to really help us assess that.”

“And in the meantime, we’re going to be drinking this water.”

Susan Pickford is an attorney who doesn’t want her town’s water to be disinfected with chloramine.

“Bathing in it, using it in cooking, and exposing ourselves to huge toxins until the EPA gets around to regulating them.”

Pickford is fighting plans to use chloramine in her central Pennsylvania town. She says there’s a better way to reduce toxic byproducts, and no one’s talking about it: filtering the water.

“If they could filter, and they can, there is filtration available that would help them filter 70 to 80 percent of those organics out of the source water, then when the chlorine cleans the water, it wouldn’t be creating all these byproducts.”

But better filtration systems are expensive. And utilities say water bills would go up for customers. That’s not popular. So they say it’s a matter of customers deciding how much of a risk they’re willing to take, and how much they’re willing to pay.

The world’s largest chemical company is fighting a lawsuit filed because of dioxin pollution. Rick Pluta reports neighbors downstream from Dow Chemical’s headquarters in Michigan want something to budge in the case:

A Dow chemical plant near the company’s headquarters in Michigan produced all kinds of products over decades, including Agent Orange. Dioxin polluted the Tittabawassee River and its flood plain. A group of 173 people have sued, after learning their property is contaminated. Many of these people have been involved in this litigation for six years. The courts still have not gotten around to their case. Attorney Theresa Golden took their case to the Michigan Supreme Court.

“The clients obviously are concerned and disappointed that it’s taken us long to get to this point.”

The group wants class action status, so every single homeowner does not have to take on the corporate giant. There are a couple thousand property downstream of this plant. And Dow does not like the idea of potentially having to pay every one of them.

Will Coal Ash Spill Get Into the Air?

In December, the massive coal ash spill at a Tennessee Valley Authority power plant in East Tennessee made people aware of a hazard they’d never really considered before. And no one knows how much of a problem it’s going to be.

“We’re looking across the Emory River.”

Matt Landon is a volunteer for the environmental group United Mountain Defense. These days, he spends a lot of time near the Tennessee Valley Authority’s ash spill site. His double respirator mask, his personal video camera and his vocal criticism of the T.V.A. have all become fixtures here. It was on one of his recent rounds near the Emory River that he saw something that scared him.

“I drove around the bend here on Emory River Road and I witnessed a massive dust storm coming off the entire coal ash disaster site.”

Landon says the dust cloud was about 70-to-80 feet high and about a half mile wide. Coal ash can contain several toxic heavy metals — like arsenic, lead, and mercury. For Landon, the site of this swirling cloud was a sobering and frightening reminder that it wouldn’t take much for the toxic materials contained in the wet cement-like sludge to dry out and become airborne.

When Landon walks up to Diana Anderson’s house on the Emory River, her shih-tzus go nuts. And no wonder. Here’s this tall, lanky guy in a double-respirator mask headed their way.

Anderson has lived here for forty years now, just downwind from the plant. And she never worried about it. But since the spill, she’s begun to notice changes in her health.

“My sinuses are irritated, I have a raspy throat, and I do a lot of coughing and my head hurts and I feel very, very, very fatigued.”

Anderson has volunteered to let Matt Landon test the air near her home. So, the two head to her kitchen sink, where they wash and prepare Pyrex dishes.

They’ll set the dishes out on Anderson’s back porch to collect dust. After a while, Landon will send the dust samples off to a lab to find out what’s in the air.

The T.V.A. is also testing the air, with help from the state of Tennessee and the E.P.A. T.V.A. Spokesman Gil Francis says they’ve already collected more than 10-thousand air samples.

“We’re taking samples 24/7, the samples are coming back that the air quality is meeting the National Air Ambient Standards and we’re going to continue to work hard to make sure that’s what the case is going forward.”

That might be easier said than done. Francis says the T.V.A. has done a lot to keep the ash from drying out and blowing around. They’ve dropped straw and grass seed from helicopters and coated the ash in an acrylic mixture. But Steven Smith of the Southern Alliance for Clean Energy says nobody really knows what it’s going to take to clean this mess up. Or how the people who live downwind will be affected.

“There are still a lot of unknowns about this. We’ve never had an ash spill this size and I think people ought to err on the side of caution.”

If there’s one bit of consolation for the people living near the Kingston coal ash spill, it’s this: the National Weather Service says that during the summer months this region is among the least windy and most humid in the country.

We know the products include cookies, crackers, snack bars, cakes, candies,
ice cream—even pet foods are affected. And there’s a chance that
potentially-contaminated food is still sitting on store shelves. And maybe in
your pantry.

Matthew Boulton is an associate professor of epidemiology. He’s at the
University of Michigan School of Public Health. He says the testing of the
Georgia facility that made these peanut-butter products shows there are
flaws in the food safety system.

“I think one of the big problems is this divide we have between the folks who do the
regulation and the folks responsible for human health. Sometimes you don’t have good
communication between those two groups and it’s really critical if you’re going to get a
handle on insuring a safe food supply.”

Boulton says this peanut-butter scare could go on for a few weeks. Or a few
months.

Toxic Toys Still on Shelves

There is already a federal limit on how much lead can be in the paint on
kids’ toys. But lead can also be in places you might not expect – like plastic
parts of toys.

The new law puts a limit on lead in any part of a toy. But the new law won’t
take effect until February 10th. So that means toys that you can buy now
can legally have very high levels of lead embedded in them.

Mike Shriberg is with the Ecology Center. It’s an environmental group
that’s been testing toys for lead.

He has an analyzer that tells you what elements are in a toy – in this case, a
plastic building block.

“So when I look at the results here, this orange block has over 3,000 parts
per million of lead. Now remember this will be illegal to be on the shelves
in February. It’s legal now because the lead’s not in the paint, it’s embedded
in the plastic.”

Babies and little kids’ brains and bodies are still developing. Since they tend
to put toys in their mouths, they’re really vulnerable to damage from lead.

“There is no safe level of lead in blood. Pediatricians have said a little bit of
lead causes a little bit of brain damage and a lot of lead causes a lot of brain
damage. We think toys shouldn’t be involved in causing any amount of
brain damage.”

Mike Shriberg says there is no way to know just by looking which toys have
lead and which ones don’t. But he says children’s jewelry is by far the
worst. They found it’s five times more likely to have lead than other toys.
He says simpler toys, such as unpainted wooden toys, tend to be safer.

“Just to be clear there is no surefire rule.”

Shriberg’s group has tested 1,500 toys this year and has put the results up on
their website: healthy-toys dot org.

The group found about one in every five toys still has lead.

Mattel and Hasbro say they’re carefully testing their toys this year. And
retailers such as Toys R Us and Wal-Mart are also testing toys.

The National Retail Federation did not return calls for comment.

The National Association of Manufacturers did not want to comment for this
story. But in a recent Wall Street Journal article – a spokesperson for the
trade group said billions of dollars in inventory could be lost when the new
lead law goes into effect.

Three billion toys are sold in the US each year. So who’s going to make
sure all those toys comply with the new law? A small government agency.

Julie Vallese is with the Consumer Product Safety Commission.

“CPSC always has investigators in the field looking for products in violation
of safety standards. Now it is a big market and we do have limited
resources. But we have a systematic way of going about looking for
violations and we will be doing that come February 10th.”

Last year, the New York Times reported that just one man, named Bob, was
responsible for testing toys for safety.

Agency officials say that’s not true – they say many people test toys. We
asked how many. We asked repeatedly. We wanted to know the exact
number of people who test toys for lead. But they refused to tell us.

Congress has promised more money for more toy testers. But that has not
happened yet.

The Consumer Product Safety Commission says besides – industry has the
biggest responsibility here.

The agency says when the new toy law goes into effect in February, it’ll be
up to the manufacturers, the retailers and the importers to make sure the toys
they’re selling are not in violation of the new lead law.

Fifteen years ago, 400,000
people got sick and more than 100 died
from contaminated drinking water. It’s
still the biggest outbreak of waterborne
disease ever in the United States. It
happened because a parasite got into the
water supply in Milwaukee. Since then,
there have been major changes in water
systems across the nation. Erin Toner
reports:

Fifteen years ago, 400,000
people got sick and more than 100 died
from contaminated drinking water. It’s
still the biggest outbreak of waterborne
disease ever in the United States. It
happened because a parasite got into the
water supply in Milwaukee. Since then,
there have been major changes in water
systems across the nation. Erin Toner
reports:

Dr. Ian Gilson has been treating AIDS patients for 25 years. He says in all that time,
nothing’s been as bad as 1993 when Milwaukee’s drinking water was contaminated with
a parasite called cryptosporidium.

“We began to get reports of some of our patients having diarrhea that didn’t stop and we
had patients with weird stuff like an ulcer that was not related to acid, severe gall bladder
disease without stones. Ultimately by the time it was called a waterborne epidemic we
knew we had a big problem on our hands.”

Healthy people who drank the water, or brushed their teeth with it, or ate food that was
washed in it, had severe vomiting and diarrhea. But people with weak immune systems,
like those HIV with AIDS, couldn’t fight the parasite. And there weren’t good AIDS
drugs back then, so the patients just deteriorated.

“I distinctly remember several patients saying if you can’t get me over this let’s just be
done with this. One guy who was suffering terribly, we couldn’t seem to get him enough
morphine. And I ordered what I thought was a fatal dose of morphine because I thought
that was the only thing that was going to help him. And it actually relieved his pain.”

When it was all over, cryptosporidium killed 103 people with HIV and AIDS. Even after
15 years, the source of the parasite is still a mystery.

“The cause is not known and may never be known. There does not seem to be any
obvious explanation.”

Carrie Lewis is superintendent of Milwaukee Water Works. She says at the time of the
outbreak, the city pumped in water through an intake pipe about a mile off shore in Lake
Michigan.

The prevailing theory is that sewage overflows contaminated water in the bay, and that
the water was pushed toward the intake pipe and entered the treatment plant.

Lewis doesn’t buy it.

She says if human sewage was the source, people would have had to be sick to excrete
the parasite, and there’s no evidence of that. Some also speculate that cow manure
contaminated area rivers, but Lewis says regular testing in the watershed rarely finds
traces of cryptosporidium.

Lewis says she has no clue what happened, and she’s OK with that. She says what’s
important is what’s changed since then. Lewis says water testing at the time of the
outbreak amounted to taking a couple of samples a day – and that was considered good.

“Today we have hundreds of instruments testing the water every single second for all
sorts of different parameters, so the 15 years that’s gone by it’s a lifetime.”

The cryptosporidium outbreak so damaged Milwaukee’s psyche that people were willing
to do just about anything to make the water safe again. The city spent $90 million to
extend the intake pipe farther out in Lake Michigan. The filters at purification plants were
updated. And now the water is treated with ozone, which kills cryptosporidium.

What happened in Milwaukee caused changes around the country.

New federal regulations required water systems to test for the parasite and safeguard
against it. A drug was licensed to treat the disease.

Michael Beach is associate director for healthy water at the Centers for Disease Control
and Prevention. He says today people should have a lot of confidence when they turn on
their tap.

“Those types of outbreaks have virtually disappeared from the tracking system.”

Many water experts say municipal drinking water in this country is now the safest in the
world. They say the legacy of the Milwaukee outbreak is that water utilities are no longer
just managing a system of pipes and water mains – they’re in the business of protecting
public health.
